Abstract

Pada skripsi ini, penulis mengangkat permasalahan mengenai pencantuman klausula baku pada aplikasi Shopee berdasarkan asas keseimbangan. Pemilihan tema tersebut didasarkan pada pencantuman klausula baku pada aplikasi Shopee yang tidak memenuhi asas keseimbangan dalam suatu perjanjian. Hal ini dikarenakan adanya klausul yang menyatakan tunduknya pedagang terhadap setiap aturan tambahan yang dibuat secara sepihak oleh Shopee. Berdasarkan permasalahan tersebut, penulis menguraikan 2 (dua) rumusan masalah yakni (1) Apakah klausula baku pada Aplikasi Shopee telah memenuhi asas keseimbangan? (2) Bagaimana pengaturan klausula baku yang memenuhi asas keseimbangan? Penelitian ini merupakan penelitian yuridis normatif dengan metode pendekatan undang-undang (statue approach). Setiap bahan hukum yang penulis peroleh (primer, sekunder, tersier) akan dianalisis dengan menggunakan teknik interprestasi sistematis yakni dengan cara menafsirkan ketentuan undang-undang. Kemudian dari hasil penelitian di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa klausula baku pada aplikasi Shopee tidak memenuhi asas keseimbangan. Lebih jauh, untuk membentuk suatu klausula baku yang memenuhi asas keseimbangan, diperlukan kerjasama dari berbagai pihak. Pelaku usaha diwajibkan untuk mematuhi ketentuan peraturan perundangundangan dan mencantumkan klausul yang memenuhi nilai-nilai asas keseimbangan. Selain itu, pemerintah juga diharapkan untuk membentuk aturan pelaksana dari ketentuan Pasal 52 huruf c UU Perlindungan Konsume agar pencantuman klausul yang tidak memenuhi asas keseimbangan dapat diminimalisir

English Abstract

In this thesis, the author raises the issue of the inclusion of standard clauses in the Shopee application based on the principle of balance. The choice of the theme is based on the inclusion of a standard clause in the Shopee application that does not meet the principle of balance in an agreement. This is because there is a clause that states the merchant's submission to any additional rules made unilaterally by Shopee. Based on these problems, the authors describe 2 (two) problem formulations, namely (1) Do the standard clauses in the Shopee Application meet the balance principle? (2) How is the standard clause set up that meets the principle of balance? This research is a normative juridical research with a status approach method. Every legal material that the author obtains (primary, secondary, tertiary) will be analyzed using a systematic interpretation technique, namely by interpreting the provisions of the law. Then from the results of the research above, the authors obtain answers to the existing problems that the standard clauses in the Shopee application do not meet the principle of balance. Furthermore, to form a standard clause that fulfills the principle of balance, cooperation from various parties is required. Business actors are required to comply with the provisions of laws and regulations and include clauses that meet the values of the principle of balance. In addition, the government is also expected to form implementing regulations from the provisions of Article 52 letter c of the Consumer Protection Law so that the inclusion of clauses that do not meet the balance principle can be minimized.
