Abstract
Penelitian ini dilatarbelakangi oleh keberadaan becak motor yang dinilai belum memenuhi persyaratan teknis dan laik jalan di Kabupaten Ngawi. Becak motor menjadi moda transportasi umum yang digemari oleh masyarakat Indonesia. angkutan semi pribadi ini melakukan pelayanan dari pintu ke pintu (door to door service) yang hanya mengangkut pemesan. Dari segala keunggulan becak motor diatas, keberadaan becak motor dibeberapa daerah dianggap ilegal. Menurut pasal 48 ayat (1) UU No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan, setiap Kendaraan Bermotor yang dioperasikan di Jalan harus memenuhi Persyaratan Teknis dan Laik Jalan. Hal ini dapat kita lihat dari bentuk-bentuk rangka serta mesin becak motor di Ngawi yang masih menggunakan motor bekas dan mesin parut kelapa tanpa rem, perlengkapan keamanan kendaraan bagi penumpang dan pengemudi, alat penunjuk kecepatan, dan emisi gas buang yang dihasilkan knalpot becak motor. Karena kembali lagi pemenuhan Persyaratan Teknis dan Laik Jalan sangat berkaitan dengan keselamatan penumpang. Metode penelitia yang digunakan adalah jenis penelitian yuridis empiris dengan menggunakan pendekatan yuridis sosiologis. Dari hasil penelitian dapat disimpulkan bahwa ketentuan yang ada dalam Pasal 48 Ayat (1) Undang-Undang No 22 tahun 2009 tentang Lalu Lintas dan Angkutan Jalan terkait Persyaratan Teknis dan Laik Jalan kendaraan becak motor tidak berjalan secara efektif. Hal ini tentunya dikarenakan adanya permasalahan dari faktor hukum, faktor penegak hukum, faktor sarana dan prasarana, faktor kebudayaan serta faktor masyarakatnya sendiri. Untuk itu pemerintah kabupaten ngawi diharapkan dapat segera membuat aturan yang digunakan sebagai pengaturan teknis terkait pengoperasian becak motor dikabupaten Ngawi terutama terkait persyaratan teknis dan laik jalan kendaraan bermotor serta peraturan yang dapat menjangkau industri rumahan.
English Abstract
This research is motivated by the existence of motorized tricycles which are considered not to meet the technical and road-worthy requirements in Ngawi Regency. Motorized rickshaws are a mode of public transportation favored by the people of Indonesia. This semi-private transportation provides door-to-door service which only transports customers. Of all the advantages of motorized rickshaws above, the presence of motorized rickshaws in some areas is considered illegal. According to article 48 paragraph (1) of Law no. 22 of 2009 concerning Road Traffic and Transportation, every Motorized Vehicle operated on the Road must meet the Technical and Roadworthy Requirements. We can see this from the shape of the frame and engine of motorized tricycles in Ngawi, which still use used motorbikes and coconut grated machines without brakes, vehicle safety equipment for passengers and drivers, speed indicators, and exhaust emissions produced by motorized tricycles. Because again the fulfillment of Technical Requirements and Roadworthiness is closely related to passenger safety. The research method used is a type of empirical juridical research using a sociological juridical approach. From the results of the study, it can be concluded that the provisions contained in Article 48 Paragraph (1) of Law No. 22 of 2009 concerning Road Traffic and Transportation related to Technical Requirements and Roadworthiness of motorized rickshaw vehicles do not run effectively. This is of course due to problems from legal factors, law enforcement factors, facilities and infrastructure factors, cultural factors and community factors themselves. For this reason, the Ngawi district government is expected to immediately make regulations that are used as technical regulations regarding the operation of motorized tricycles in Ngawi district, especially regarding technical requirements and roadworthiness of motorized vehicles as well as regulations that can reach home industries.
