Abstract

Penelitian ini mengangkat permasalahan mengenai penegakan sanksi administratif terhadap penertiban reklame di Kantor Satuan Polisi Pamong Praja Kota Mojokerto. Pemilihan tema ini dilatarbelakangi permasalahan banyaknya papan reklame ilegal yang bermasalah, papan reklame yang seharusnya sudah habis masa izinnya dan penempatan yang salah tidak sesuai sehinga melanggar Peraturan Daerah Kota Mojokerto Nomor 2 Tahun 2020 tentang Penyelenggaraan Reklame. Penelitian ini menggunakan jenis penelitian secara empiris (sosio legal) yang melihat kenyataan dalam lapangan, dengan menggunakan penelitian yuridis sosiologis yaitu dengan melihat kenyataan hukum serta aspek-aspek yang berkaitan dengan interaksi sosial di dalam masyarakat dan menggunakan teknis analisis kualitatif. Lokasi penelitian yaitu pada Kantor Satpol PP Kota Mojokerto yang melaksanakan urusan pemerintahan dan tugas pembantuan di bidang kentraman dan ketertiban umum serta perlindungan masyarakat dan Kantor DPMPTSP untuk mengetahui jenis-jenis izin penyelenggaraan reklame dan mengetahui Standar Operasional (SOP) yang sesuai. Dari hasil penelitian dengan menggunakan metode diatas, maka penulis memperoleh jawaban terkait permaslaahn yang ada bahwa tindakan yang dilakukan oleh Satpol PP Kota Mojokerto sebagai penegak Perda di dalam lapangan sudah berjalan cukup baik namun masih terdapat beberapa hambatan. Sehingga untuk mengatasi hal tersebut Satpol PP Kota Mojokerto berupaya dengan melakukan berbagai solusi yang diberikan sehingga penertiban reklame akan berjalan dengan sesuai dan lebih maksimal.

English Abstract

This research raises the issue of the enforcement of administrative sanctions against the enforcement of billboards at the Pamong Praja Police Unit Office of Mojokerto City. The selection of this theme is motivated by the problem of the number of problematic illegal billboards, billboards that should have expired permits and incorrect placement is not appropriate so as to violate Mojokerto City Regional Regulation No. 2 of 2020 on the Implementation of Billboards. This research uses a type of research empirically (socio-legal) that looks at reality in the field, using sociological juridical research, namely by looking at legal realities as well as aspects related to social interaction in society and using technical qualitative analysis. The research location is at the Mojokerto Municipal Police Satpol Office which carries out government affairs and assistance duties in the field of kentraman and public order as well as community protection and the DPMPTSP Office to find out the types of billboard implementation permits and know the appropriate Operational Standards (SOPs). From the results of the study using the above methods, the author obtained answers related to existing regulations that the actions taken by Satpol PP Kota Mojokerto as law enforcement in the field have been going quite well but there are still some obstacles. So as to overcome this Satpol PP Kota Mojokerto seeks to do various solutions provided so that the regulation of billboards will run accordingly and more maximally.
