Abstract

Pertumbuhan kendaraan yang tinggi dengan tingkat laju jaringan jalan yang cenderung statis menyebabkan kelambatan (delay) dan kemacetan (queue) hampir di seluruh wilayah di Indonesia”. Kemacetan lalu lintas saat ini memang telah menjadi benang kusut yang sulit dicari pangkal ujungnya dan mengakibatkan banyaknya kerugian. Usaha pemerintah untuk memecahkan masalah transportasi perkotaan telah banyak dilakukan, baik dengan meningkatkan kapasitas jaringan jalan yang ada maupun dengan pembangunan jaringan jalan yang baru, ditambah dengan rekayasa dan manajemen lalu lintas terutama pengaturan efisiensi transportasi angkutan umum dan penambahan armadanya. Akan tetapi betapapun besarnya biaya yang dikeluarkan, kemacetan tidak bisa dihindari. Pengaturan pembatasan kendaraan perseorangan sebagai salah satu cara manajemen pengendalian lalu lintas di atur dalam Pasal 133 ayat (2) huruf a Undang-Undang No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan (UU LLAJ) dengan persyaratan Pasal 133 ayat (1). Selain retribusi pengendalian lalu lintas (Pasal 133 ayat (3) UU LLAJ dan PP 97 Tahun 2012), pembatasan kendaraan juga dilakukan dengan berpedoman Pasal 60 ayat (2) huruf a PP No. 32 Tahun 2011 dilakukan dengan dasar jumlah penumpang dan plat nomor kendaraan dan pengunaan retribusi pengendalian lalu lintas sebagai pungutan dalam pembatasan kendaraan perseorangan. Faktanya pembatasan yang disediakan dalam ketentuan tersebut tidak dapat menyelesaikan masalah kemacetan, justru menimbulkan persoalan hukum berupa ketidak jelasan dan ketidaklengkapan cara pembatasan kendaraan perseorangan serta konflik atau pertentangan norma hukum pembatasan kendaraan perseorangan yang mengakibatkan kerugian ekonomi, udara bersih dan sehat, serta hak konstitusional warga negara sebagaimana Pasal 28 D ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, sehingga menimbulkan masalah dari aspek filsafat, yuridis, dan teoritis. Rumusan masalah dalam penelitian ini adalah, pertama, Bagaimana konsep pembatasan kendaraan bermotor perseorangan yang mampu mewujudkan kelancaran dan keadilan berlalu dlintas di Indonesia ? kedua, bagaimana implikasi pengaturan pembatasan kendaraan perseorangan yang tidak mewujudkan kelancaran dan keadilan berlalu lintas di Indonesia? Ketiga, bagaimana reformulasi pengaturan pembatasan kendaraan perseorangan dimasa yang akan datang yang mampu mewujudkan kelancaran dan keadilan berlalu lintas di Indonesia? Dan untuk dapat memecahkan masalah tersebut di digunakan teori sebagai analisis dengan mengunakan teori fungsi dan tujuan hukum, teori keadilan, teori peraturan perundang-undangan (teori jenjang hukum/stufentbou heorie, teori legitimasi dan validitas hukum, teori Preferensi Hukum, teori konflik norma hukum), dan teori kewenangan. Penelitian disertasi ini merupakan penelitian hukum normatif dengan mengunakan pendekatan filsafat, pendekatan konseptual (conceptual approach), pendekatan undang-undang (statute approach), pendekatan komparatif (comparative approach) untuk mereformulasi pengaturan pembatasan kendaraan perseorangan di Indonesia.

English Abstract

The high growth of vehicles with a level of rate of road networks that tend to be static causes delay and congestion (queue) almost in all regions in Indonesia". Current traffic jams have indeed become tangled threads that are difficult to find at the end and cause a lot of losses. Government efforts to solve urban transportation problems have been carried out, both by increasing the capacity of existing road networks and by building new road networks, coupled with engineering and traffic management, especially the regulation of the efficiency of public transportation and the addition of its fleets. However, no matter how much the costs incurred, congestion cannot be avoided. The regulation of restrictions on individual vehicles as a way of managing traffic control is regulated in Article 133 paragraph (2) letter a of Law No. 22 of 2009 concerning about Road Traffic and Transportation (UU LLAJ) with the requirements of Article 133 paragraph (1). In addition to traffic control fees (Article 133 paragraph (3) LLAJ Law and PP 97 of 2012), vehicle restrictions are also carried out by referring to Article 60 paragraph (2) letter a PP No. 32 of 2011 was carried out on the basis of the number of passengers and vehicle license plates and the use of traffic control retribution as a levy in limiting individual vehicles. The fact that the restrictions provided in the provision cannot solve the problem of congestion, actually raises legal problems in the form of obscurity and incompleteness in the ways of limiting individual vehicles and conflicts or conflicts of legal norms limiting individual vehicles resulting in economic losses, clean and healthy air, and citizens' constitutional rights as Article 28 D paragraph (1) of the 1945 Constitution of the Republic of Indonesia, giving rise to problems from philosophical, juridical and theoretical aspects. The formulation of the problem in this study is, first, How does the concept of limiting individual motorized vehicles capable of achieving smoothness and justice pass in Indonesia? second, what are the implications of the regulation of restrictions on individual vehicles that do not manifest traffic smoothness and justice in Indonesia? Third, how to reformulate the restrictions on the regulation of individual vehicles in the future that are capable of realizing traffic smoothness and justice in Indonesia? And to be able to solve the problem, the theory used as an analysis using the theory of function and purpose of law, the theory of justice, the theory of legislation (legal theory/Stufentheorie, legitimacy and legal validity theory, Legal Preference theory, legal norm conflict theory), and the theory of authority. This dissertation research is normative legal research using a philosophical approach, conceptual approach, statute approach, comparative approach to reformulate the regulation of restrictions on individual vehicles in Indonesia. The results of the study found that first, the concept of individual vehicles limitation is an effort to control traffic on the road by reducing the number of motorized vehicle production, controlling its ownership and use of vehicles on the road with or without traffic control in creating traffic smoothness and justice on the road. second, the implications of the regulation of limited legal violations for the government in setting limits on motorized vehicles, the implementation of law enforcement and tests on the limits of motorized vehicles in Indonesia especially for limiting number of private vehicles by companies based on Article 28 D of the 1945 Constitution of the Republic of Indonesia. Third, reformulating the LLAJ Law, article 133 paragraph (2) letter a and harmonization of implementing regulations PP No. 32/2011, PP 97/2012 by implementing changes with legal norms relating to liability for borders, collection fees, tariff rate, objects, sanctions and violations of laws limiting vehicles to people paying attention to the Pancasila values and the 1945 Constitution of the Republic of Indonesia are the principles listed in Law No. 12 of 2011 in order to realize the fluency and justice of traffic. Recommendations for the need to expand the meaning or concept of restrictions on motorized vehicles in the LLAJ Act so that they are not limited to use or movement on the road but also include other restrictions on reducing motorized vehicle production, controlling ownership and use or movement of vehicles on the road with or without traffic levy and to the Government and the DPR-RI immediately reformulate the LLAJ Law specifically for the regulation of Article 133 paragraph (2) letter a LLAJ Law regarding restrictions on individual vehicles by expanding and clarifying the form of vehicle restrictions, levies and traffic control rates, sanctions, enforcement and harmonization of regulations implementation related to legal norms on vehicle restrictions, so as to provide certainty and confidence for transport operators to realize transportation goals as mandated by the LLAJ Law.
