Abstract

Pada skripsi ini, penulis mengangkat permasalahan penjualan bebas pakaian bekas hasil impor illegal yang dilakukan oleh pelaku usaha. Pilihan tema tersebut dilatarbelakangi oleh belum adanya bentuk informasi baku terkait kelayakan jual dan kelayakan pakai untuk pakaian bekas sebagai bentuk perlindungan konsumen yang wajib dilakukan oleh pelaku usaha atau penjual pakaian bekas di Indonesia. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah: (1) Apa makna tentang “Informasi secara lengkap, benar dan aman” yang terkandung dalam pasal 8 ayat 2 Undang – Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen? Selanjutnya penulisan karya tulis ini berdasarkan metode yuridis normatif dengan menggunakan pendekatan perundang-undangan (statute approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis selanjutnya dianalisis menggunakan analisis penafsiran secara sistematis, yaitu menafsirkan suatu ketentuan peraturan perundangundangan yang ada dengan menghubungkannya dengan peraturan hukum atau undangundang yang lainnya dengan keseluruhan sistem hukum. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban yang ada bahwa makna yang terkandung dalam pasal 8 ayat 2 Undang – Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen adalah terkait “informasi secara lengkap, benar dan aman untuk Kesehatan konsumen” terkait kelayakan jual dan kelayakan pakai pada pakaian bekas hasil impor agar siap untuk dijual. Penulis menyusun makna dari “informasi secara lengkap, benar dan aman untuk Kesehatan konsumen” menurut Pasal 1 angka 1 dari Undang – Undang Nomor 14 Tahun 2008 Tentang Keterbukaan Informasi Publik sebagai pengertian atas informasi dan pasal 19 dan pasal 22 ayat 1 Undang – Undang Nomor 18 Tahun 2008 Tentang Pengelolaan Sampah disertai Pasal 16, Pasal 17, Pasal 18, Pasal 19, Pasal 21 dan Pasal 22 dari Peraturan Pemerintah Nomor 81 Tahun 2012 Tentang Pengelolaan Sampah Rumah Tangga dan Sampah Sejenis Sampah Rumah Tangga sebagai bentuk atas informasi kelayakan jual dan kelayakan pakai dalam perdagangan pakaian bekas. Dari pasal-pasal tersebut disusun dan disimpulkan penulis menjadi prosedur Informasi kelayakan jual dan pakai sebagai berikut: (1) pemilahan atau sortir; (2) pengolahan dengan cara pencucian, (3) pengecekan ulang dan (4) pengemasan. Prosedur kelayakan jual dan kelayakan pakai pada penjualan pakaian bekas tersebut adalah jawaban dari bentuk “informasi secara lengkap, benar dan aman untuk Kesehatan konsumen” yang belum ada bentuk baku dalam pasal 8 ayat 2 Undang – Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen.

English Abstract

In this thesis, the author raises the issue of the free sale of used clothing from illegal imports carried out by business actors. The choice of the theme was motivated by the absence of standard forms of information related to the feasibility of selling and using used clothing as a form of consumer protection that must be carried out by business actors or sellers of used clothing in Indonesia. Based on the above, this paper raises the formulation of the problem: (1) What is the meaning of "Complete, correct and safe information" contained in Article 8 paragraph 2 of Law Number 8 of 1999 concerning Consumer Protection? Then the writing of this paper uses a normative juridical method with a statute approach. The primary, secondary and tertiary legal materials obtained by the author will be analyzed using a systematic interpretation analysis, which is interpreting a provision of existing laws and regulations by relating them to other legal regulations or laws with the entire legal system. From the results of the research using the above method, the authors obtain an existing answer that the meaning contained in Article 8 paragraph 2 of Law Number 8 of 1999 concerning Consumer Protection is related to "complete, correct and safe information for consumer health" related to the feasibility of selling and the feasibility used on imported used clothes so that they are ready for sale. The author compiles the meaning of "complete, correct and safe information for consumer health" according to Article 1 number 1 of Law Number 14 of 2008 concerning Public Information Disclosure as an understanding of information and article 19 and article 22 paragraph 1 of Law Number 18 2008 concerning Waste Management accompanied by Article 16, Article 17, Article 18, Article 19, Article 21 and Article 22 of Government Regulation Number 81 of 2012 concerning Management of Household Waste and Waste Similar to Household Waste as a form of information on the feasibility of selling and the feasibility of using in the used clothing trade. From these articles, the writer concludes that the procedures for selling and using feasibility information are as follows: (1) sorting or sorting; (2) processing by washing, (3) re-checking and (4) packaging. The procedure for selling suitability and suitability for selling used clothing is the answer to the form of "complete, correct and safe information for consumer health" which does not yet have a standard form in Article 8 paragraph 2 of Law Number 8 of 1999 concerning Consumer Protection.
