Abstract

Pada skripsi ini penulis mengangkat isu terkait implementasi hak pekerja perempuan untuk menyusui. Pekerja Wanita khususnya ibu menyusui di PT PG. Pesantren Baru Kediri yang memiliki pekerja wanita berjumlah 19 orang, Sampai saat ini pekerja wanita tersebut masih belum mendapatkan haknya untuk menyusui di ruang laktasi. Selain itu penulis juga membahas apa kendala-kendala apa saja yang menyebabkan pekerja wanita menyusui sampai saat ini tidak mendapatkan haknya yaitu menyusui di ruang laktasi, serta upaya-upaya apa saja agar kedepannya pekerja wanita menyusui mendapatkan haknya. Rumusan Masalah pada skripsi ini adalah: (1) Bagaimana pelaksanaan Pasal 83 Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan, terkait ibu menyusui di PT PG.Pesantren Baru Kediri? (2) Bagaimana kendala serta upaya pemberlakuan Pasal 83 Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan, terkait ibu menyusui di PT PG. Pesantren Baru Kediri? Penelitian ini merupakan penelitian empiris dengan metode pendekatan yuridis sosiologis. Bahan Hukum yang digunakan dalam peneltian ini dianalisis dengan menggunakan teknik deskriptif kualitatif yang kemudian menggambarkan data-data yang telah terkumpul dan kemudian diperoleh kesimpulan secara umum tentang keadaan sebenarnya. Dari hasil penelitian yang dilakukan, peneliti mendapatkan bahwa Implementasi perlindungan hukum terhadap pekerja perempuan yang bekerja di PG Pesantren Baru Kediri, tidak efektif dilaksanakan pada tempat PG Pesantren Baru Kediri khususnya ruang laktasi. Faktor yang menghambat ini lahir dari unsur struktur hukum, substansi hukum serta budaya hukum yang terkait. Dari hambatan yang muncul, upaya yang dapat dilakukan terkait substansi hukum adalah dengan melakukan pembaharuan hukum ketenagakerjaan dalam memberikan perlindungan hukum terhadap pekerja/buruh perempuan. Pada struktur hukum, perlu meningkatkan pengawasan sesuai prinsip pengawasan ketenagakerjaan dan dalam pengawasan pemberdayaan perempuan dan melakukan pengawasan secara rutin dan berkala terhadap perusahaan yang mempekerjakan pekerja/buruh perempuan di tempat Pabrik Gula di Kediri dan juga melakukan penambahan jumlah pegawai pengawas ketenagakerjaan. Terkait budaya hukumnya, pengusaha harus mentaati peraturan perundang-undangan khususnya pada Pasal 83 dan perlu meningkatkan pemahaman perlindungan hukum untuk memperhatikan kesejahteraan pekerja/buruh perempuan. Upaya yang terakhir adalah meningkatkan sinergi segala pihak yang berkaitan dengan Surat Edaran Peraturan Bersama Menteri Negara Pemberdayaan Perempuan dan Perlindungan Anak, Menteri Tenaga Kerja dan Transmigrasi, dan Menteri Kesehatan Nomor 48/Men.PP/XII/2008, PER.27/MEN/XII/2008, 1177/Menkes/PB/XII/2008 tentang Peningkatan Pemberian ASI Selama Waktu Kerja di Tempat Kerja.

English Abstract

In this thesis, the author raises issues related to the implementation of women workers' rights to breastfeed that are less effective. Female workers, especially breastfeeding mothers at PT PG. The Kediri New Islamic Boarding School has 19 female workers. Until now, these female workers have not yet received their rights to breastfeed in the lactation room. In addition, the author also discusses what are the obstacles that cause breastfeeding women workers to not get their rights, namely breastfeeding in the lactation room, as well as any efforts so that in the future breastfeeding women workers get their rights. The formulation of the problem in this thesis are: (1) How is the implementation of Article 83 of Law Number 13 of 2003 concerning Employment, related to breastfeeding mothers at PT PG. Pesantren Baru Kediri? (2) What are the obstacles and efforts to implement Article 83 of Law Number 13 of 2003 concerning Employment, regarding breastfeeding mothers at PT PG. Kediri's New Islamic Boarding School? The research used by the author is empirical juridical research and uses a descriptive approach. The results after the author conducted research, namely, as for several obstacles including: from the Supervision of the Office of Manpower and Transmigration of East Java Province related to the fulfillment of lactation room facilities to breastfeed their children in Kediri City because of the emergence of Law Number 23 of 2014 concerning Regional Government which regulates labor inspection has become the authority of the Department of Manpower and Transmigration of East Java Province. In addition, the distance between the Supervision office of the Manpower and Transmigration Office of East Java Province to each city takes a long time, long distances and expensive accommodation costs. The small number of supervisors is not proportional to the number of companies in East Java. In every city in East Java, access from supervisors to carry out impromptu inspections, which is difficult, has also been an obstacle so far. In addition, the absence of human resources and the diversity of problems that arise so that this implementation tends to be ineffective are one of the obstacles, thus making the Women's Empowerment Office of the city of Kediri not pay attention to socialization related to the fulfillment of lactation room facilities for breastfeeding mothers. Low legal awareness by breastfeeding women workers results in ignorance of breastfeeding women workers having the right to breastfeed in the lactation room. There are more male workers than female workers, making PG Pesantren Kediri override the rights of female workers to provide room facilities for breastfeeding.
