Abstract

Pada Penelitian ini penulis mengangkat permasalahan tentang bagaimana presepsi aparat penegak hukum Satreskrim Polresta Malang Kota dalam melakukan penegakan terhadap Pasal 27 ayat (1) Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik berkenaan dengan Prostitusi Online pada Media Sosial di Kota Malang. Dimana ditemukan permasalahan yang ada dalam prostitusi online media sosial di kota malang yakni peran penegak hukum dari Satreskrim Polresta Malang Kota memiliki persepsi sendiri dalam melakukan upaya penegakan hukum, untuk mengatasi pelanggaran terhadap pasal 27 Ayat (1) Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik terkait Prostitusi Online. Rumusan Masalah yang terdapat pada penelitian ini adalah apa persepsi aparat penegak hukum Satreskrim Polresta Malang terhadap Pasal 27 Ayat (1) Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik tentang Prostitusi Online pada Media Sosial di Kota Malang ?. Apa hambatan Satreskrim Polresta Malang dalam penegakan Pasal 27 Ayat (1) Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik terkait Prostitusi Online pada Media Sosial di Kota Malang?. Metode penelitian yang digunakan adalah Penelitian ini menggunakan metode penelitian sosiolegal, yang mana metode penelitiannya merupakan kombinasi antara metode penelitian hukum doktriner atau hukum yang tertulis dan metode penelitian hukum empirik (yang meminjam metode ilmu sosial), maka yang dilakukan peneliti adalah studi dokumen, yang disertai dengan studi lapangan. Dari hasil penelitian dengan metode diatas, Penulis memperoleh persepsi Penyidik Satreskrim Polresta Malang Satreskrim Polresta Malang Kota terkait fenomena prostitusi online pada media sosial yang terjadi di Kota malang serta hambatan yang dialami dan upaya guna dalam menegakkan upaya hukum prostitusi online di media sosial yang ketentuannya diatur pada Pasal 27 Ayat (1) Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik. Sehingga hambatan yang ditemukan adalah tidak adanya satuan cybercrimes dalam struktur Satreskrim Polresta Malang Kota serta diharuskannya aparat penegak hukum Satreskrim Polresta Malang Kota untuk meminta izin terlebih dahulu kepada Pengadilan Negeri Malang sesuai dengan prosedur KUHAP untuk melakukan penangkapan terhadap para wanita tuna susila pelanggar pada Pasal 27 Ayat (1) Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik

English Abstract

In this study, the authors do research about the problem of how the perception of law enforcement officers of the Malang City Police Criminal Investigation Unit in enforcing Article 27 paragraph (1) of Law Number 19 Year 2016 concerning Information and Electronic Transactions regarding Online Prostitution on Social Media in Malang City. Where there are problems that exist in online social media prostitution in Malang city, namely the role of law enforcers from the Malang City Police Criminal Investigation Unit has their own perceptions in making law enforcement efforts, to overcome violations of article 27 Paragraph (1) of Law Number 19 Year 2016 concerning Information and Electronic Transactions related to Online Prostitution. The formulation of the problem contained in this study is what is the perception of the Malang Police Satreskrim law enforcement officers of Article 27 Paragraph (1) of Law Number 19 Year 2016 concerning Information and Electronic Transactions on Online Prostitution on Social Media in Malang City? What are the obstacles of the Malang Police Satreskrim in enforcing Article 27 Paragraph (1) of Law Number 19 Year 2016 concerning Information and Electronic Transactions related to Online Prostitution on Social Media in Malang City ?. The research method used is this research uses sociolegal research methods, in which the research method is a combination of doctrinal legal research methods or written law and empirical legal research methods (which carry social science methods), so what the researcher does is document study, which is accompanied by with field studies. From the results of the research using the above method, the author obtained the perception of the Malang City Police Satreskrim Investigator Malang City Criminal Investigation Unit related to the phenomenon of online prostitution on social media that occurred in Malang City as well as the obstacles experienced and efforts to enforce online prostitution legal efforts on social media whose provisions are regulated in Article 27 Paragraph (1) of Law Number 19 of 2016 concerning Electronic Information and Transactions. So that the obstacles found are the absence of a cybercrimes unit in the structure of the Malang City Police Satreskrim and the need for law enforcement officers from the Malang City Police Satreskrim to first seek permission from the Malang District Court in accordance with the KUHAP procedure to arrest prostitutes who violate Article 27 Paragraph (1) Law Number 19 of 2016 concerning Information and Electronic Transactions
