Abstract
Pada skripsi ini, penulis mengangkat permasalahan mengenai urgensi konsep hakim Pemeriksa Pendahuluan dalam sistem peradilan pidana di indonesia. Konsep ini dianggap menjadi alternatif pengganti sistem pra-peradilan yang saat ini belum efektif dalam mengurangi miscarriage of justice atau peradilan sesat, sehingga masih banyak korban yang jatuh dalam penanganan perkara dalam tingkat penyelidikan maupun penyidikan. Maka dari itu, penulis mengjaki konsep hakim pemeriksa pendahuluan dengan melihat konsep hakim pemeriksa pendahuluan di Negara Italia dan Belanda. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah: (1) Apa urgensi Hakim Pemeriksa Pendahuluan dalam suatu sistem peradilan pidana? (2) Bagaimana sebaiknya Pengaturan Hakim Pemeriksa Pendahuluan dimasa yang akan datang sebagai upaya mengurangi Miscarriage of Justice dalam sistem peradilan pidana di indonesia? Kemudian penulisan karya tulis ini menggunakan metode yuridis normatif dengan metode pendekatan konseptual (conseptual approach) dan pendekatan perbandingan (comparative approach). Bahan hukum primer, sekunder dan tersier yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisis Penafsiran Gramatikal dan Penafsiran Sistematis dan Penafsiran Futuristik. Dari hasil penelitian dengan metode diats, penulis memperoleh jawaban atas permasalah yang ada bahwa konsep hakim pemeriksa pendahuluan masih memiliki banyak kekurangan dapat beresiko tidak sesuai dengan sistem peradilan pidana di Indonesia. Saran penulis dalam penilitian ini adalah tetap mempertahankan sistem praperadilan dengan cacatan menambahkan tugas dan wewenangya agar lebih luas.
English Abstract
In this thesis, the author raises the issue of the urgency of the concept of Preliminary Examining judges in the criminal justice system in Indonesia. This concept is considered to be an alternative to the pre-trial system which is currently not effective in reducing miscarriages of justice or misguided justice, so that there are still many victims who fall in the handling of cases at the investigation and investigation level. Therefore, the author explores the concept of preliminary examining judges by looking at the concept of preliminary examining judges in Italy and the Netherlands. Based on the above, this paper raises the formulation of the problem: (1) What is the urgency of the Preliminary Examining Judge in a criminal justice system? (2) How should the Preliminary Examination Judge Arrangements in the future as an effort to reduce Miscarriage of Justice in the criminal justice system in Indonesia? Then the writing of this paper uses a normative juridical method with a conceptua lapproach and comparative approach. The primary, secondary and tertiary legal materials obtained by the author will be analyzed using the analysis techniques of Grammatical Interpretation and Systematic Interpretation and Futuristic Interpretation. From the results of the research using the above method, the authors obtain answers to the existing problems that the concept of preliminary examining judges still has many shortcomings and can risk being inconsistent with the criminal justice system in Indonesia.
