Abstract

Dalam penelitian skripsi ini, peneliti mengangkat tentang efektivitas pasal 15 peraturan daerah nomor 4 tahun 2009 tentang pengelolaan tempat parkir di Kota Malang terhadap juru parkir liar. Yang menjadi latar belakang permasalahan tersebut adalah karena maraknya petugas parkir atau juru parkir tidak resmi yang tersebar di Kota Malang hal itu dapat dibuktikan dengan masih adanya petugas parkir yang tidak memiliki Surat Penunjukan & Kartu Tanda Pengenal Juru Parkir. Maka hal ini telah melanggar Peraturan Daerah Kota Malang Nomor 4 Tahun 2009 Pasal 15 Ayat (3). Penelitian skripsi ini mengangkat rumusan masalah: Bagaimana Efektivitas Pasal 15 Peraturan Daerah No. 4 Tahun 2009 terhadap keberadaan juru parkir tidak resmi di tepi jalan umum daerah Kota Malang dan Apa kendala dan upaya Dinas Perhubungan Kota Malang penegakan hukum pada pelaksanaan Peraturan Daerah Nomor 4 Tahun 2009 tentang Pengelolaan Tempat Parkir. Penelitian skripsi ini merupakan penelitian hukum yuridis empiris dengan menggunakan metode pendekatan penelitian yuridis sosiologis. Lokasi penelitian yang dipilih oleh penulis untuk melakukan penelitian guna mendapatkan informasi bahanbahan yang akurat adalah wilayah Kota Malang. Data primer diperoleh dari wawancara, observasi, serta data tertulis hasil wawancara dari dinas atau instansi terkait. Kemudian data sekunder diperoleh dari kajian terhadap peraturan perundang-undangan terkait, literatur, dan karya ilmiah serta artikel yang berupa hasil penelitian sebelumnya yang terkait dengan permasalahan. Berdasarkan hasil penelitian diketahui bahwa, (1) ditinjau dari permasalahan yang didapatkan dengan hasil kuisioner terdapat 76% juru parkir sudah mematuhi peraturan, dapat disimpulkan bahwa peraturan dan upaya hukum yang dilaksanakan oleh Dinas Perhubungan Kota Malang sudah cukup efektif, namun perlunya pengoptimalan kembali guna antisipasi kerugian masyarakat dan negara khususnya dalam hal pendapatan daerah melalui retribusi daerah. (2) Peran masyarakat sama pentingnya dengan personil anggota dinas perhubungan dengan melakukan pelaporan melalui aplikasi sambat online sehingga juru parkir liar yang melanggar aturan akan segera ditindaklanjuti oleh petugas Dinas Perhubungan Kota Malang secara tegas

English Abstract

In this thesis, the researcher raised the effectiveness of article 15 of regional regulation number 4 of 2009 concerning the management of parking lots in the city of Malang against illegal parking attendants. The background to this problem is that there are many parking attendants or unofficial parking attendants scattered in the city of Malang, it can be proven by the fact that there are parking attendants who do not have a letter of appointment and a parking attendant's identification card. So this has violated the Malang City Regional Regulation Number 4 of 2009 Article 15 Paragraph (3). This thesis research raises the formulation of the problem: How is the Effectiveness of Article 15 of Regional Regulation no. 4 of 2009 on the existence of unofficial parking attendants on the edge of public roads in Malang City and what are the obstacles and efforts of the Malang City Transportation Service to enforce law on the implementation of Regional Regulation No. 4 of 2009 concerning Parking Place Management. This thesis research is an empirical juridical law research using a sociological juridical research approach. The research location chosen by the author to conduct research in order to obtain accurate material information is the area of Malang City. Primary data were obtained from interviews, observations, and written data from interviews from the relevant offices or agencies. Then secondary data was obtained from a study of related laws and regulations, literature, and scientific works as well as articles in the form of the results of previous research related to the problem. Based on the results of the study, it is known that, (1) in terms of the problems obtained with the results of the questionnaire, there are 76% of parking attendants who have complied with the regulations, it can be concluded that the regulations and legal remedies implemented by the Malang City Transportation Service are quite effective, but there is a need for re-optimization to anticipate community and state losses, especially in terms of regional income through regional retribution. (2) The role of the community is as important as that of members of the transportation agency by reporting through an online splice application so that illegal parking attendants who violate the rules will immediately be followed up by the Malang City Transportation Service officer firmly
