Abstract

Pada skripsi ini, penulis membahas permasalahan mengenai status hukum internasional terkait perdagangan minyak squalene dari spesies hiu terancam punah dengan alasan untuk produksi vaksin COVID-19 menurut hukum internasional. Alasan di pilihnya tema tersebut adalah karena adanya upaya untuk mengembangkan vaksin COVID-19 oleh beberapa perusahaan biomedis asing menggunakan minyak squalene yang berasal dari liver hiu, sehingga dapat membahayakan spesies-spesies hiu yang sudah masuk kedalam kategori terancam punah. Berdasarkan permasalahan tersebut, penulis mengangkat rumusan-rumusan masalah berupa : 1. Apakah hukum internasional memperbolehkan perdagangan terhadap minyak squalene dari hiu terancam punah dengan alasan untuk pengembangan vaksin COVID-19? 2. Bagaimanakah perbandingan perdagangan terhadap minyak squalene hiu untuk pengembangan vaksin COVID-19 dengan legalisasi perdagangan oleh CITES terhadap gading gajah Afrika? Penelitian skripsi ini menggunakan penelitian hukum yuridis normatif dan menggunakan metode pendekatan perundang-undangan, dan pendekatan kasus. Bahan-bahan hukum primer, sekunder, dan tersier yang telah diperoleh oleh penulis akan dianalisis menggunakan teknik deskriptif kualitatif yaitu menganalisa status dan kedudukan hukum terhadap perdagangan internasional terkait minyak squalene hiu dalam pengembangan vaksin COVID-19. Dari hasil penelitian, penulis memperoleh jawaban atas permasalahan perdagangan terhadap minyak squalene tersebut, bahwa perdagangan tersebut diperbolehkan oleh hukum internasional selama berada dalam pengawasan ketat serta sesuai dengan ketentuan CITES, General Exceptions GATT, dan prinsip-prinsip hukum lingkungan internasional Rio Declaration. Sedangkan untuk penyelesaian terhadap masalah, penulis memberi kesimpulan bahwa dapat mengambil contoh terhadap kasus perdagangan internasional terkait gading gajah Afrika

English Abstract

In this thesis, the author will discuss the problems of the legal status on squalene oil from endangered shark species for the production of COVID-19 vaccines according to the international law. The reason this topic is chosen is because the trade and vaccine developement and production by of foreign biomedical companies using squalene oil would further imperil the population of endangered shark species. Based on the problem above, the author raise a couple of formulations : 1. Does International law allow the trade on shark squalene oil for the purposes of developing COVID-19 vaccine? 2. How does the trade in shark squalene oil for COVID-19 vaccine development compare with the legalization of trade by CITES in African elephant tusks? This thesis use a normative juridical legal research, using statutory approach, and case approach. Primary, secondary and tertiary legal sources that had been collected by the writer, will be using qualitative descriptive, which analized the legal status of the international trade on the shark squalene oil for the purpose of COVID-19 vaccine developement. From the results of this research, the author obtained the answer on the problem regarding the international trade on the shark squalene oil. The trade are allowed and the international law as long it is done under strict observation and done accordingly with the regulations of CITES, GATT General Exceptions, and the Rio Declaration principles on environmental law. And for the solutions for the problem, the author concludes that the international trade on shark squalene oil for the purpose of COVID-19 vaccines developement could take examples from the case of the international trade on African elephant ivory between the African countries and Japan and China
