Abstract

enulis mengangkat permasalahan Faktor-Faktor yang Mempengaruhi Pelaksanaan Pasal 77 Peraturan Daerah Kota Malang Nomor 1 Tahun 2018 Mengenai Pemberian Insentif Bagi Pemilik Cagar Budaya. Pilihan tema tersebut di latar belakangi pada permasalahan yang terjadi pada pemilik Cagar Budaya di Kota Malang yang tidak sepenuhnya mengerti tentang adanya peraturan hukum yang mengatur tentang pemberian insentif terhadap pemilik cagar budaya dan Sebagian ada juga yang acuh tidak acuh tentang keuntungan yang di dapat dari diterapkannya peraturan mengenai pemberian insentif bagi pemilik Cagar Budaya tersebut. Berdasarkan hal tersebut perlunya perluasaan sosialisasi terhadap pemilik pemilik Cagar Budaya karena memang di Kota Malang ini sudah adanya peraturan yang mengaturnya megenai pemberian insentif berupa pengurangan PBB sebesar 50% dan pemberian bantuan lainnya berupa plakat yang menandakan bahwa bangunan tersebut memanglah sudah di resmikan oleh Pemerintah Daerah Kota Malang menjadi bagian dari Cagar Budaya. Ada juga pemilik Cagar Budaya mengharapkan pemberian insensit lain berupa biaya pemeliharaan yang memang tidakalah didapatkan oleh para pemilik cagar budaya yang menginginnkannya. Pemberian insentif tersebut sudah di jabarkan dalam Peraturan Daerah Kota Malang Nomor 1 Tahun 2018 Mengenai Pemberian Insentif Bagi Pemilik Cagar Budaya. Berdasarkan hal tersebut diatas, Rumusan masalah dalam karya tulis ini: 1. Apakah faktor-faktor yang mempengaruhi pelaksanaan Pasal 77 Peraturan Daerah Kota Malang Nomor 1 Tahun 2018 mengenai pemberian insentif pada pemilik cagar budaya di kota Malang? 2. Bagaimana upaya dalam menanggulangi hambatan pemberian insentif kepada pemilik cagar budaya berdasarkan Pasal 77 Peraturan Daerah Kota Malang Nomor 1 Tahun 2018 di Kota Malang? Metode yang dguakan dalam karya tulis ini menggunakan metode penelitian Yuridis Empiris dengan yang dimana metode penelitian yang bertitik tolak dari data primer yang diperoleh langsung dari masyarakat sebagai sumber utama dengan melalui penelitian lapangan, dan data sekunder yang di peroleh dari bahan hukum atau informasi kepustakaan (library research) yang memberikan penjelasan terhadap data primer, berupa peraturan perundang-undangan dan literatur terkait dengan permasalahan yang dibahas. Dari hasil penelitian dengan metode diatasm penulis memperoleh jawaban atas permasalahan yang ada bahwa pemberian insentif terhadap pemilik Cagar Budaya berupa pengurangan PBB sebesar 50% yang secara otomatis sudah di kurangi setelah pemilik Cagar Budaya mengurus prosesnya dengan cara : mengambil SK kepemilikan bangunan Cagar Budaya di Dinas Pendidikan dan Kebudayaan Kota Malang, kemudian mengurusnya di Bapenda ( Badan Pendapatan Daerah) pada saat pembayaran PBB dari bangunan Cagar Budaya tersebut.

English Abstract

The author raises the issue of Factors Affecting the Implementation of Article 77 of Malang City Regional Regulation Number 1 of 2018 Regarding Incentives for Cultural Heritage Owners. The choice of this theme is based on the problems that occur to Cultural Heritage owners in Malang City who do not fully understand the existence of legal regulations governing incentives for cultural heritage owners and some are indifferent about the benefits that can be obtained from implementing regulations. regarding the provision of incentives for the owner of the Cultural Conservation. Based on this, there is a need for socialization to the owner of Cultural Heritage because indeed in Malang City, there are regulations that regulate it regarding the provision of incentives in the form of a 50% reduction in PBB and the provision of other assistance in the form of placards which indicate that the building has indeed been inaugurated by the City Regional Government. Malang is a part of the Cultural Heritage. There are also cultural heritage owners who expect other incentives in the form of maintenance costs that are not obtained by the cultural heritage owners who want them. The provision of these incentives has been outlined in the Regional Regulation of Malang City Number 1 of 2018 concerning Providing Incentives for Cultural Heritage Owners. Based on the foregoing, the formulation of the problem in this paper: 1. What are the factors that influence the implementation of Article 77 of Malang City Regional Regulation Number 1 of 2018 regarding the provision of incentives for cultural heritage owners in Malang city? 2. 2. How are efforts to overcome obstacles to providing incentives to cultural heritage owners based on Article 77 of Malang City Regional Regulation Number 1 of 2018 in Malang City? The method used in this paper uses the juridical empirical research method where the research method is based on primary data obtained directly from the community as the main source through field research, and secondary data obtained from legal materials or library information (library). research) which provides an explanation of primary data, in the form of legislation and literature related to the issues discussed. From the results of the research with the above method, the writer gets the answer to the existing problem that the provision of incentives for Cultural Heritage owners in the form of a reduction of the PBB of 50% which is automatically reduced after the Cultural Heritage owner takes care of the process by: taking a Decree on the ownership of the Cultural Heritage building at the Education Office and Malang City Culture, then take care of it at the Bapenda (Regional Revenue Agency) at the time of the PBB payment from the Cultural Heritage building.
