Abstract
Dalam penulisan penelitian skripsi ini, Penulis mengangkat judul Status Hukum Penggunaan Kode Unik Dalam Sistem Pembayaran Oleh Marketplace Pada Transaksi Perjanjian Jual – Beli Melalui E - Commerce. Yang melatar belakangi Penulis mengangkat judul ini dikarenakan Perkembangan Teknologi informasi dan telekomunikasi semakin hari semakin canggih, contohnya dalam perjanjian jual – beli melalui internet atau secara elektronik yang biasanya disebut e-commerce. Di dalam e-commerce terdapat banyak macam metode pembayaran dalam transaksi jual – beli tersebut. Dalam metode pembayaran transfer via bank ini menggunakaan penambahan nominal 3 digit dari angka terakhir total pembayaran atau yang biasanya disebut sebagai kode unik. Penggunaan Kode Unik ini dalam metode pembayaran di marketplace mempunyai ketidakpastian hukum. Dimana penambahan atas nominal kode unik tidak terdapat kejelasan mekanisme akan pengembalian nominal kode unik dan kejelasan arah dananya. Berdasarkan latar belakang tersebut, Penulis mengangkat 2 rumusan masalah sebagai berikut : 1) Bagaimana status hukum penggunaan kode unik dalam sistem pembayaran oleh marketplace pada transaksi perjanjian jual – beli melalui e-commerce ?. 2) Bagaimana bentuk perlindungan hukum preventif bagi konsumen dalam hal penggunaan kode unik dalam sistem pembayaran oleh marketplace pada transaksi perjanjian jual – beli melalui e-commerce ?. Dalam penelitian ini Penulis menggunakan metode penelitian Penelitian yuridis normatif, dimana pada jenis penelitian ini, dilakukan berdasarkan bahan hukum utama dengan cara menelaah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian ini.
English Abstract
In writing this study research, the author raises the title of the Legal Status of the Use of Unique Codes in the Payment System by the Marketplace in the Purchase and Purchase Agreement Transactions through E-Commerce. The background for the author to raise this title is because the development of information technology and telecommunications is increasingly sophisticated, for example in buying and selling agreements via the internet or electronically which is usually called e-commerce. In e-commerce, there are many kinds of payment methods for buying and selling transactions. In this bank transfer payment method, you use the addition of a nominal 3 digits from the last digit of the total payment or what is usually referred to as a unique code. The use of this Unique Code in payment methods in the marketplace has legal uncertainty. Where the addition of the unique code nominal, there is no clarity on the mechanism for returning the unique code nominal and the clarity of the direction of the funds. Based on this background, the author raises 2 problem formulations as follows: 1) What is the legal status of the use of unique codes in the payment system by the marketplace in buying and selling agreements through e-commerce ? 2) What is the form of preventive legal protection for consumers in terms of the use of unique codes in the payment system by the marketplace in buying and selling agreements through e-commerce ? In this study the author uses a normative juridical research research method, where in this type of research, it is carried out based on the main legal materials by examining theories, concepts, legal principles and statutory regulations related to this research.
