Abstract
Pada skripsi ini, penulis mengangkat permasalahan Konsep Pengaturan Pihak Ketiga Dalam Pemberian Ganti Kerugian Sebagai Bentuk Pemenuhan Kewajiban Pelaku Anak Kepada Korban Tindak Pidana Kesusilaan. Pilihan tema tersebut dilatar belakangi oleh adanya putusan pengadilan yang menghukum pelaku anak untuk membayar restitusi kepada korban. Apabila pelaku merupakan anak, maka restitusi dapat diberikan oleh pihak ketiga. Tetapi dalam peraturan yang berlaku belum mengatur mengenai siapa pihak ketiga yang dimaksud. Berdasarkan hal tersebut, karya tulis ini mengangkat rumusan masalah : (1) Siapakah pihak ketiga yang dimaksud dalam peraturan perundang-undangan untuk melakukan pembayaran ganti kerugian sebagai bentuk pemenuhan kewajiban pelaku anak kepada korban tindak pidana kesusilaan? (2) Bagaimana konsep pengaturan pihak ketiga dalam pemberian ganti kerugian sebagai bentuk pemenuhan kewajiban pelaku anak kepada korban tindak pidana kesusilaan? Penulisan karya tulis ini menggunakan jenis penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer, sekunder, dan tersier. Bahan hukum yang diperoleh dianalisis menggunakan metode interpretasi atau penafsiran. Hasil dan pembahasan yang diperoleh yaitu terdapat kekaburan hukum yang mana tidak ada penjelasan maupun pengaturan tentang pihak ketiga yang berkewajiban membayar restitusi, sehingga dapat dibentuk suatu konsep pengaturan untuk mengisi kekaburan hukum kewajiban pihak ketiga untuk mengambil alih kewajiban membayar restitusi pelaku anak kepada korban tindak pidana kesusilaan.
English Abstract
In this thesis, the writer discusses about the problem of the Concept of Third Party Indemnity as a Fulfillment the Obligations of Child Offenders to Victims of Crime Decency. This selected topic was motivated by a court decision punishing the child offender to pay a restitution to the victim. The payment of restitution can be done by the third party if the perpetrator is a child. However, the laws and regulations do not yet regulate who is the third party. Therefore, this thesis raised the problem about : (1) Who is the third party referred to the regulations to pay the restitution for fulfilling the obligations of child decency crime? (2) What is the concept of the third party indemnity arrangements as a fulfilling the obligations of child offenders to the victims of crimes decency? This thesis uses a normative juridical research method with a normative legal research using legislative approach and a conceptual approach. The Legal materials that used in this research are primary legal materials, secondary legal materials, and tertiary legal materials obtained through literature studies. The legal materials obtained were analyzed using the method of interpretation. Based on the result, there is a legal obscurity in the regulations of governing restitution, there is no explanation or regulation regarding the third party who is obliged to pay restitution, so that a regulatory concept can be formed to full fill the legal obscurity of the third party's obligation to take over the obligation to pay restitution of child offenders to victims of crimes decency.
