Abstract
Peredaran konten pornografi marak terjadi di media sosial. Peredaran ini dapat melalui berbagi antara satu pengguna dengan pengguna lain, maupun melalui jual beli. Di Kota Malang sendiri salah satu kasus jual beli konten pornografi terjadi ditahun 2016. Polri sebagai instansi pemerintah yang bertugas menjaga ketertiban dan keamanan masyarakat tentu memiliki peran untuk mencegah terjadinya perbuatan tersebut. Salah satu upaya yang dilakukan Polri untuk mencegah terjadinya transaksi jual beli konten pornografi di media sosial adalah dengan melakukan kegiatan patroli siber, yang dilakukan oleh Cyber Troops Kepolisian Resor di setiap Kabupaten/Kota. Rumusan masalah dalam skripsi ini adalah : (1) Apakah landasan pembentukan Cyber Troops Polresta Malang Kota sesuai dengan Peraturan Kepala Kepolisian Negara Republik Indonesia Nomor 23 Tahun 2010 tentang Susunan Organisasi dan Tata Kerja Pada Tingkat Kepolisian Resort dan Kepolisian Sektor ? (2) Apakah patroli siber yang dilakukan Cyber Troops Polresta Malang Kota untuk pencegahan jual beli pornografi melalui media Sosial melanggar hak asasi pengguna media sosial ? (3) Bagaimana seharusnya strategi yang dilakukan oleh Cyber Troops Polresta Malang Kota agar patroli siber dapat dilaksanakan secara optimal dalam rangka pencegahan Transaksi Jual-Beli Pornografi melalui media Sosial ? Penulis membahas tiga permasalahan tersebut menggunakan metode penelitian hukum yuridis empiris, dengan pendekatan yuridis-sosilologis. Data primer, sekunder dan tersier yang diperoleh menggunakan teknik wawancara, observasi, dan studi dokumen dianalisis dengan teknik analisis deskriptif-kualitatif yaitu menguraikan data hasil penelitian kemudian mengaitkan dengan teori Strukturasi dan pendekatan pencegahan situasional dalam kejahatan. Hasil penelitian ini adalah sebagai berikut. (1) Dasar hukum pembentukan Cyber Troops Polresta Malang Kota adalah Surat Edaran Kapolri No.: SE/6/X/2015 tentang Penanganan Ujaran Kebencian. Perluasan kewenangan Cyber Troops dalam mengawasi konten pornografi dalam rangka pencegahan sesuai dengan ketentuan Pasal 40 ayat 2(a) UU-Perubahan UU- ITE, dan Kapolres sebagai unsur pemerintah dalam urusan ketertiban dan keamanan sebagaimana diatur dalam Pasal 2 UU Polri dan Pasal 5 Perkapolri No. 23 Tahun 2010 memiliki kewenangan diskresi yaitu melakukan keputusan sesuai dengan kebutuhan konkret di masyarakat (Pasal 6 ayat (2) UU-Administrasi Pemerintahan). (2) Pencegahan yang dilakukan Cyber Troops tidak melanggar hak asasi pengguna media sosial karena setiap anggota Cyber Troops diberi penugasan secara resmi oleh Kapolresta dan didasarkan pada kewenangan sah sebagaimana diatur UU-Polri dan UU-ITE. (3) strategi yang harus dilakukan oleh Cyber Troops agar dapat lebih optimal dalam mencegah transaksi jual beli pornografi melalui media sosial, yaitu Mengintensifkan dialog antara Cyber Troops dengan anggota masyarakat secara online, menjalin kemitraan dan kerja sama dengan masyarakat dan para pemangku kepentingan (stake holders), dan meningkatkan keterpaduan dengan Satuan Fungsi Kepolisian di Lingkup Polresta Malang Kota dan Instansi lain di luar Polri.
English Abstract
The circulation of pornographic content is rife on social media. This distribution can be done through sharing between one user and another, as well as through buying and selling. In Malang City, one of the cases of buying and selling pornographic content occurred in 2016. The National Police as a government agency in charge of maintaining public order and security certainly has a role in preventing these acts. One of the efforts made by the National Police to prevent the sale and purchase of pornographic content on social media is by conducting cyber patrol activities, which are carried out by the Cyber Troops of the Resort Police in every Regency / City. The formulation of the problems in this thesis are: (1) What is the basis for the formation of the Malang City Police Cyber Troops in accordance with the Regulation of the Head of the National Police of the Republic of Indonesia Number 23 of 2010 concerning Organizational Structure and Work Procedures at the Resort Police and Sector Police Levels? (2) Does the cyber patrol carried out by the Malang City Police Cyber Troops to prevent the buying and selling of pornography through social media violate the human rights of social media users? (3) How should the strategy carried out by the Malang City Police Cyber Troops so that cyber patrols can be carried out optimally in the context of preventing pornography buying and selling transactions through social media? The author discusses these three problems using juridical empirical legal research methods, with a juridical-sociilological approach. Primary, secondary and tertiary data obtained using interview, observation, and document study techniques were analyzed using descriptive- qualitative analysis techniques, namely describing the research data then linking it with Structural theory and situational prevention approaches in crime. The results of this study are as follows. (1) The legal basis for the formation of the Malang City Police Cyber Troops is the Chief of Police Circular No .: SE / 6 / X / 2015 concerning Handling Hate Speech. The expansion of Cyber Troops' authority in monitoring pornographic content in the context of prevention is in accordance with the provisions of Article 40 paragraph 2 (a) of the Law-Amendment of UU-ITE, and the Chief of Police as an element of government in matters of order and security (Article 2 of UU-Polri) has discretionary authority, namely to carry out decisions in accordance with concrete needs in society (Article 6 paragraph (2) Law-Government Administration). (2) The prevention carried out by Cyber Troops does not violate the human rights of social media users because each member of the Cyber Troops is officially assigned by the Police Chief and is based on legal authority as regulated by the Law-Polri and UU-ITE. (3) as well as strategies that must be carried out by Cyber Troops in order to be more optimal in preventing the buying and selling of pornography through social media, namely Intensifying dialogue between Cyber Troops and community members online, establishing partnerships and collaborating with the community and other stakeholders. holders), and improve integration with the Police Function Units within the Malang City Police and other agencies outside the National Police.
