Abstract
Pada skripsi ini, penulis mengangkat permasalahan terkait Kekuatan Pembuktian dari Visum Et Repertum Veteriner Sebagai Alat Bukti Dalam Penegakan Hukum Tindak pidana Terhadap Satwa Yang Dilindungi. Pemilihan terhadap tema tersebut dilatarbelakangi oleh semakin meningkatnya kasus tindak pidana terhadap satwa dilindungi dari hari ke hari. Dan akibat dari kurang efektifnya penegakan hukum terhadap permasalahan ini, maka sangat diperlukan perkembangan metode pembuktian yang berdasar pada ilmu kedokteran hewan forensik. Berdasarkan hal tersebut, karya tulis ini mengangkat rumusan masalah : (1) Bagaimana urgensi visum et repertum veteriner sebagai alat bukti tindak pidana terhadap satwa yang dilindungi ? (2) Bagaimana kekuatan pembuktian dari visum et repertum veteriner sebagai alat bukti tindak pidana terhadap satwa yang dilindungi? Penulisan skripsi ini menggunakan jenis penelitian yuridis normatif dengan metode pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis, dianalisis dengan menggunakan teknik interpretasi gramatikal dan teknik penafsiran sistematis. Hasil analisis mengungkapkan bahwa faktor utama tidak terselesaikannya kasus tindak pidana terhadap satwa yang dilindungi adalah kurangnya alat bukti. Dan kehadiran Visum Et Repertum Veteriner dari keilmuan dokter hewan forensik dapat menjadi suatu bentuk perkembangan sebagai metode pendekatan dalam proses penyidikan. Visum Et Repertum Veteriner juga telah memenuhi sebagai alat bukti yang sah sebagaimana yang dimuat dalam Pasal 184 KUHAP
English Abstract
In this thesis, the author raises issues related to The Power of Visum Et Repertum Veteriner as a Piece of Evidence in a Criminal Offence against Protected Animals. The choice of this theme is based on the fact by the increasing number of cases of criminal actions against protected animal from day by day. And the lack of effective law enforcement on this problem, it is necessary to develop evidence methods based on forensic veterinary science. Based on this, this paper raises the formulation of the problem : (1) How is the urgency of visum et repertum veteriner as a piece of evidence in a criminal offence against protected animals ? (2) How is the power of visum et repertum veteriner as a piece of evidence in a criminal offence against protected animals ? The writing of this thesis uses a normative juridical research method with a statutory approach and a conceptualy approach. The primary, secondary, and tertiary legal materials obtained by the author were analyzed using grammatical interpretation techniques and systematic interpretation techniques. The result of this thesis show that the main factor in the unresolved case of crimes against protected animal was the lack of evidence. And the presence of veterinary visum et repertum from forensic veterinary science can be a form of development as an approach method in the investigation process. Veterinary visum et repertum has also fulfilled as valid evidence as contained in Article 184 of the Criminal Procedure Code.
