Abstract
Penelitian ini dilatarbelakangi oleh adanya peraturan yang melarang masyarakat bermain layang-layang di Kota pontianak, yakni Pasal 19 Peraturan daerah Kota Pontianak Nomor 11 Tahun 2019 tentang Ketertiban Umum. Namun kenyataannya, masih banyak masyarakat yang bermain layang-layang sehingga terjadi kesenjangan antara das sein dengan das sollen. Tujuan penelitian ini ialah untuk mengetahui dan menganalisis efektivitas Pasal 19 Peraturan Daerah Nomor 11 Tahun 2019 tentang Ketertiban Umum terhadap larangan bermain layang-layang di Kota Pontianak, serta faktor-faktor penghambat dan solusi yang dilakukan Satuan Polisi Pamong Praja Kota Pontianak sebagai penegak dalam efektivitas Pasal 19 Peraturan Daerah Nomor 11 Tahun 2019 tentang Ketertiban Umum terhadap larangan bermain layang-layang di Kota Pontianak. Penelitian ini menggunakan teknik yuridis empiris dengan metode pendekatan yuridis sosiologis, serta data yang diperoleh dianalisis menggunakan teknik deskriptif kualitatif. Hasil penelitian menyatakan bahwa Pаsаl 19 Perаturаn Dаerаh Nomor 11 Tаhun 2019 Tentаng Ketertiban Umum belum berjаlаn efektif dikаrenаkаn beberаpа fаktor dаri teori efektivitаs hukum yаng dikemukаkаn oleh Soerjono Soekаnto tidаk terpenuhi. Hal tersebut dikаrenаkаn oleh penegаk hukumnyа yаkni DINSATPONTI dаn dipengаruhi oleh mаsyаrаkаt yаng kesаdаrаn untuk memаtuhi perаturаn hukum yаng berlаku mаsih rendаh. Sertа upаyа yаng dilаkukаn Dinаs Satpol PP sudаh cukup bаik nаmun mаsih perlu ditingkаtkаn lаgi.
English Abstract
In this thesis, the author examines the problem of the prohibition of playing kites in Pontianak City. The author chose this problem as a background of the existence of a regulation that prohibits everyone from playing kites in Pontianak City, namely in Article 19 of Pontianak City Regional Regulation Number 11 of 2019 concerning Public Order. In fact, in society, there are still many people who play kites, so there is a gap between das sein and das sollen. For this reason, the purpose of this study is to analyze the effectiveness and law enforcement of Article 19 of Pontianak City Regional Regulation Number 11 of 2019 concerning Public Order. Based on the above, this research raises the formulation of the problem: (1) How effective is Article 19 of Regional Regulation Number 11 of 2019 concerning Public Order against the prohibition of playing kites in Pontianak City? (2) What are the inhibiting factors and what is the solution made by the Pontianak City Civil Service Police Unit as the enforcer in the effectiveness of Article 19 of Regional Regulation Number 11 of 2019 concerning Public Order against the prohibition of playing kites in Pontianak City? The writing of this paper uses juridical empirical research with a sociological juridical approach. Primary data were collected using interview techniques with Heri Suwito, S.H., M.H. The head of the investigation and investigation section of the Pontianak City Civil Service Police Unit and the questionnaire were addressed to the people of Pontianak City in locations close to public places, while secondary data was collected using documentation techniques. The data obtained by the author were analyzed using qualitative descriptive techniques. From the results of this research, it can be concluded that Article 19 Regional Regulation No.11 of 2019 Regarding Public Order has not been implemented effectively because several factors from Soo's theory of effectiveness are fulfilled. The unfulfilled factors are caused by law enforcement officers, namely the Pontianak Municipal Civil Service Police Unit and are also influenced by many people who are willing to obey strict rules of law. The efforts carried out by the Civil Service Police Unit Office have been quite good but can still be at an advanced level.
