Abstract
Penulisan ini dilatarbelakangi dengan ketidakjelasan rumusan terkait makna frasa eksploitasi secara ekonomi dalam Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak terkait batasan-batasannya. Menggunakan metode yuridis normatif, mengggunakan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum yang digunakan bahan hukum primer dan sekunder. Teknik penelusuran bahan hukum melalui studi dokumen (kepustakaan). Teknik analisis bahan hukum dilakukan dengan cara deduktif dari umum kekhusus, selain itu menggunakan penafsiran gramatikal, sistematis, dan teleologis. Eksploitasi secara ekonomi merujuk pada Pasal 66 dapat dimaknai dengan kegiatan berupa pemanfaatan tenaga anak, tanpa atau dengan persetujuan anak mendapatkan keuntungan secara materiil. Penggunaan logo merek perusahaan dalam penerimaan beasiswa merupakan kegiatan eksploitasi secara ekonomi dikarenakan memenuhi unsur yang terdapat dalam Pasal 66, dimana dengan atau tanpa persetujuan anak, menggunakan badan anak sebagai media promosi dalam hal ini penggunaan logo merek yang tidak sesuai dengan kebutuhan anak, untuk mendapatkan keuntungan secara materiil yang dapat dinominalkan. Perlu adanya reformulasi dikarenakan tidak adanya rumusan pasal yang secara jelas mendefinisikan eksploitasi secara ekonomi berupa penambahan frasa Pada penjelasan Pasal 66, “melibatkan anak dalam kegiatan promosi produk berbahaya atau yang sejenis oleh pihak lain, dengan sengaja/atau tidak sengaja”, kemudian penambahan frasa pada Pasal 76I yakni, “ dalam proses produksi, distribusi, dan konsumsi barang atau jasa dengan cara manipulasi, pelanggaran hak-hak anak, atau perlakuan buruk lainnya terhadap anak bertujuan mengambil keuntungan dari orang lain.
English Abstract
This research departed from an unclear definition of the phrase ‘economic exploitation’ as stated in Law Number 35 of 2014 concerning Child Protection in terms of its scope. With a normative-juridical method, statutory and conceptual approach, this research employed primary and secondary research from library resources. The data were analysed based on deductive technique, grammatical, systematic, and teleological methods. The term economic exploitation refers to Article 66 defining exploitation as to make use of children with or without any consent from the children and the consideration whether the children will benefit from this. Using a company logo in scholarship-granting is considered as economic exploitation since it meets the criteria outlined in Article 66 since a company logo is used with or without the consent of the children, and such use is not relevant to the children’s need and since it is aimed to gain financial profit. Due to this case, reformulation is needed since there are no articles clearly defining economic exploitation by adding a phrase to what has been outlined in Article 66 “involving children in the promotion of harmful products by other parties, intentionally or unintentionally”. The phrase “in the production process, distribution, goods and services using manipulation, violation of the rights of the children, or poor treatment to children that are intended to gain profit from others” also needs to be added to Article 76I.
