Abstract
"An agreement made by two parties sometimes causes loss one of the parties has to face as what is outlined in Decision Number 1123/Pdt.G/2019/PN.Sby in which a lawsuit is filed by a lessee aiming to protect his right to the property he rented when it came to a financial issue faced by the owner who rented out the object that was still within the period of instalment but this owner failed to continue the payment to the bank which provided the loan. This situation was followed by an action of repossessing the object by the developer, as in line with what has been outlined in the agreement. The lessee was not aware that this was the case. This research aims to analyse the legal consequences of Court Decision Number 1123/Pdt.G/2019/PN.Sby rejecting the lawsuit filed by the lessee on the leasing agreement between the two parties. With a normative juridical method, case, and conceptual approaches, this research has found out that this agreement is null and void since it was found contravening Article 1320 of Civil Code point 4 regarding Halal Causes. The legal connection between the parties is deemed inexistent, and not a single party should be harmed or should face any loss caused. Following the court decision, the lessee could lose his/her right to the object rented out, and the person who owns the object to rent out no longer has his right to receive any payment of rent from the lessee, while the money that has been paid as part of the renting must be returned to the lessee. The position of the bank as a creditor that provided the loan is to enforce the condition that requires the party who rented out to pay off the debt. Keywords : legal consequence, judge’s decision, right to rent, rented object Perjanjian yang dibuat antara dua belah pihak dalam perjanjian seringkali membawa kerugian bagi salah satu pihak dalam perjanjian salah satu kasusnya yaitu terdapat dalam Putusan No : 1123/Pdt.G/2019/PN.Sby.Gugatan tersebut diajukan oleh penyewa yang ingin melindungi hak sewa pada perjanjian sewa menyewa yang mana saat berlangsungnya masa sewa pemberi sewa mengalami kredit macet terhadap pembiayaan objek sewa yang dibiayai oleh Bank sehingga objek sewa akan diambil alih oleh Developer sesuai kesepakatan dalam perjanjian. Dalam hal ini penyewa yang tidak mengetahui bahwa objek sewa masih belum lunas dan mengalami kredit macet sehingga akan merugikan masa sewa sebagaimana dalam perjanjian sewa menyewa. Penelitian ini bertujuan untuk menganalisis Akibat Hukum Terhadap Perjanjian Sewa Menyewa Dan Para Pihak pada Putusan Hakim Yang Menolak Gugatan Penggugat Terhadap Sahnya Sebagai Pemilik Hak Sewa Atas Objek Sewa sebagai Jaminan Hutang dalam Putusan No : 1123/Pdt.G/2019/PN.Sby. metode penelitian yang digunakan adalah jenis penelitian yuridis normatif dengan pendekatan kasus dan pendekatan konseptual. Hasilnya Akibat hukum terhadap perjanjian sewa menyewa yang dilakukan Penyewa dengan Pemberi Sewa yakni batal demi hukum karena bertentangan dengan pasal 1320 KUHPerdata unsur 4 mengenai suatu sebab yang halal sehingga perjanjian tersebut tidak sah dan berlaku. Sehingga akibat hukum para pihak dalam perjanjian sewa yakni hubungan hukum dianggap tidak pernah terjadi dan tidak boleh ada pihak yang dirugikan sebagai bentuk kembali pada kondisi semula. Maka akibat hukum bagi penyewa yaitu kehilangan hak sewanya dalam perjanjian sewa menyewa tersebut dan Akibat hukum terhadap Pemberi sewa yaitu tidak memiliki hak pada perjanjian tersebut maka pembayaran sewa oleh penyewa harus dikembalikan. Sedangkan akibat hukum terhadap Kreditur dalam perjanjian kredit yakni perjanjian sewa menyewa yang batal demi hukum menguatkan hak Bank terhadap objek sengketa untuk pelunasan kredit macet yang dilakukan Pemberi sewa.
