Abstract

Penelitian ini dilatar belakangi dengan semakin lama bank menunjukan eksistensinya dalam bidang perekonomian suatu negara serta semakin nyata pula peranan bank yang diberikan kepada masyarakat, akan tetapi seiring dengan perkembangan perekonomian global, kini kerap ditemukan beberapa tindakan kecurangan dalam kegiatan perbankan. Salah satunya, kasus yang menimpa Subarjo selaku Debitur BPR Agra Arthaka Mulya, dimana data pribadinya digunakan oleh Direktur Utama BPR Agra Arthaka Mulya untuk menurunkan realisasi kredit demi kepentingan pribadi Direktur Utama BPR Agra Arthaka Mulya. Penulisan karya tulis ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Dari hasil penelitian dengan menggunakan metode tersebut, penulis memperoleh jawaban atas permasalahan yang ada bahwa pelaksanaan perlindungan hukum bagi debitur dapat diwujudkan dalam bentuk perlindungan preventif dan represif. Perlindungan hukum preventif dengan melaksanakan ketentuan peraturan perundang-undangan yang berlaku serta mempertegas klausula dalam perjanjian terkait adanya penggunaan Data Pribadi Nasabah dalam tindakan realisasi kredit. Perlindungan hukum represif diberikan dalam beberapa tahapan yang dilakukan oleh Hakim dengan mengabulkan beberapa petitum, akan tetapi perlindungan represif belum sepenuhnya terpenuhi dengan tidak adanya ganti rugi yang dituntut kepada Kreditur atas kerugian yang diderita Debitur.

English Abstract

In this thesis, the author raises issues related to the legal consequences of the misuse of financing in wakalah contracts in murabahah financing. This is motivated by differences in the unclear specifications of the goods in the wakalah contract, giving rise to a dominant position for customers in controlling financing funds for the purchase of goods. The customer purchases goods that are not in accordance with the agreement in the agreement and violates the subjective element as stated in Article 20 of the KHES and 1320 of the Civil Code. This results in the destruction of the agreed contract. Based on the foregoing, this thesis raises the formulation of the problem as follows: what are the legal consequences of misuse of financing in wakalah contracts in murabaha financing? The type of research used by the author to examine the problem is normative juridical with the type of legal material using primary and secondary legal materials. The approach method that the author uses is the Legislative Approach (Statue Approach) and the Analytical Approach (analytical Approach), the method of analyzing legal materials uses the Law approach. From the results of this study, it can be concluded that the misuse of wakalah contract financing for murabahah financing stems from an element of ambiguity in including the specifications of the goods to be purchased by the customer. This clause has violated the provisions of the subjective element regarding the terms of agreement on the object of the contract as stated in Article 20 of the KHES and Article 1320 of the Civil Code and has legal consequences for the destruction of the contract. The existence of a will defect makes the legal status of the wakalah contract belonging to a sharia bank to be damaged or a facade. The damaged contract must be canceled by the parties through a court decision or dispute resolution that has been stipulated in the contract. The misuse of the financing also gave rise to a new right between the two parties, namely the khiyar right. The bank as the aggrieved party can decide or cancel the contract based on the agreement period. The change in liability lies with the bank as the seller, namely changing the role of the bank to the supplier to deliver the goods to the customer. Misuse of financing also results in the transfer of ownership of objects as a result of differences in objects. The purchased goods are deemed to have become the personal property of the buyer in accordance with Article 471 paragraph (2) of the KHES. Deviations by customers can be subject to sanctions according to KHES for not carrying out what was agreed upon.
