Abstract
Tujuan penelitian ini adalah untuk menganalisis penerapan pendaftaran hak atas tanah komunal Masyarakat Hukum Adat di Desa Adat Pakraman Bungbungan, Kabupaten Jembrana, serta mencari hambatan dan upaya yang telah dilakukan oleh Pemerintah. Metode penelitian yang penulis gunakan adalah penelitian hukum, jenis penelitian hukum empiris, melalui pendekatan yuridis sosiologis, Lokasi penelitian ini akan dilakukan di Desa Pakraman Bungbungan. Adapun Hasil Penelitian ini adalah: Sudah terdapat 110 KK di Desa Pakraman Bungbungan yang telah mendaftarkan tanahnya, Pada pelaksanaannya proses pendaftaran tanah tidaklah mudah karena adanya beberapa hambatan diantaranya adalah Kurangnya pemahaman masyarakat terhadap pendaftaran tanah Desa Adat Pakraman dan mengenai Subyek Haknya dari Keputusan Menteri ATR/BPN Nomor 276/KEP-19.2/X/2017, Adapun upaya yang dilakukan oleh Pejabat Pertanahan adalah memberikan informasi melalui sosialisasi dan pendekatan intens kepada masyarakat bahwa meskipun tanah tersebut telah bersertifikat tetapi tanah tersebut tidak dapat diperjualbelikan dan akan selamanya menjadi milik desa. Hal ini dikarenakan subjek hak nya terletak pada Desa Adat Pakraman dan Obyeknya dikuasai secara komunal oleh masyarakat adat secara turun temurun.
English Abstract
This research is aimed tol analyse the implementation of registration of rights to communal land in customary village Pakraman Bungbungan, Regency of Jembrana, and to find out the impeding factors and measures taken by the govemment regarding the issue. This is an empirical research that employed legal research method with socio-juridical approach, where the research took place in Pakraman village, Bungbungan. The research reveals that there are 110 families in the village registering their lands, but in the process, they found hindrance due to several factors such as the people’s awareness of land registration in the village and the subject of their rights regarding the ministerial decree of Agrarian and Spatial Planning/Nation Land Agency Number 276/KEP-19.2/X/2017. The land official has attempted to spread information and introduce what needs to be the society Moreover, intense approach to the society is also performed, emphasising that the land registration performed by the people will not give them any rights to sell the lands and they will aways be under the ownership of the village simply because the subject of the right is located in Pakraman customary village and the object is communally owned by the people through generations.
