Abstract
Pada skripsi ini penulis mengangkat permasalahan terkait peran Visum et Repertum dalam proses penyelidikan tindak pidana penganiayaan. Untuk menindak lanjuti pemeriksaan tindak pidana penganiayaan, pihak kepolisian sangat membutuhkan bantuan keterangan ahli yang mana dapat menentukan adanya unsur-unsur tindak pidana penganiayaan agar dapat segera dilakukan penyidikan. Penelitian ini dilakukan untuk mengetahui eksistensi peranan Visum et Repertum bagi pihak kepolisian dalam menindak lanjuti penyelidikan tindak pidana penganiayaan, faktor penghambat utama bagi kepolisian dalam penyelidikan tindak pidana penganiayaan terkait keberadaan Visum et Repertum, dan metode yang diterapkan oleh pihak kepolisian dalam penyelidikan tindak pidana penganiayaan untuk mengatasi faktor penghambat selain mengacu dari hasil Visum et Repertum. Penelitian ini dilakukan dengan jenis penelitian yuridis empiris dengan metode pendekatan yuridis sosiologis. Dari hasil penelitian, penulis memperoleh jawaban atas permasalahan yang ada bahwa penyelidik atas perintah penyidik dapat mengajukan Visum et Repertum guna mengetahui terdapat unsur-unsur penganiayaan atau tidak dan dengan segera dilakukan penyidikan. Mengenai faktor penghambat utama dalam penyelidikan tindak pidana penganiayaan terkait Visum et Repertum yaitu korban maupun keluarga korban tidak mau untuk dilakukan Visum, kurangnya koordinasi pihak puskesmas/rumah sakit dengan kepolisian. Beberapa metode penyelidikan yang diterapkan kepolisian yaitu teknik wawancara dengan menggali keterangan lebih dalam terhadap korban dan saksi-saksi yang terkait dengan tindak pidana penganiayaan serta mengkoordinir lebih lanjut mengenai kerja sama kepolisian dengan puskesmas/rumah sakit untuk memberikan keterangan hasil Visum et Repertum.
English Abstract
On this thesis writer raised issues concerning the role of medical check in the process investigation criminal act of persecution. To crack down on examination pursue the criminal act of persecution, the police really need help information expert who where it can be determine the existence elements criminal act of persecution in order to immediately investigations. This research conducted to determine existence of the role medical check for the police in take up the investigation of crimes of persecution, the main barrier for police in the investigation of crimes related to the existence of persecution of medical, and the method applied by the police in the investigation crimes of persecution to overcome the barrier in addition refers from the results of medical check. The research is conducted by the type of juridical empiric research with a method of approach juridical sociological. From this research, writer received the answer to the existing problems that investigators on the orders investigators can submit medical check to know there are elements of persecution or not and quickly investigations. On the main barrier in the investigation of crimes of persecution associated medical check namely the victims and the victims don’t want to do medical check, the lack of coordination clinic/hospital with police. Several methods of investigation is applied the technique of police interviews with more information to know in against the victims and witnesses related to crimes of persecution and coordinating further on police cooperation with the clinic or hospital to give details of medical check results.
