Abstract
Hak rakyat atas air minum telah dijamin oleh negara dengan Peraturan Pemerintah Nomor 122 Tahun 2015 bahwa Sistem Penyediaan Air Minum (SPAM) dilaksanakan untuk “memenuhi” Hak rakyat atas air minum, sedangkan pada peraturan pelaksaannya yaitu pada Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat (PUPR) Nomor 27 tahun 2016 tentang Penyelenggaraan SPAM dijelaskan pada pasal 2 ayat (2) menggunakan diksi yang lebih kuat yaitu “menjamin” Hak rakyat atas air minum. Penelitian ini berfokus pada satu pasal dalam Peraturan Menteri PUPR tersebut yaitu pasal 35 yang menerangkan tentang Proses Dasar Manajemen Penyelenggaraan SPAM yang dilakukan oleh kelompok masyarakat yang pada pasal 33 Peraturan tersebut disebutkan bahwa proses dasar manajemen Penyelenggaranan SPAM “menyesuaikan” dengan kemampuan masyarakat. Peneliti menggunakan metode penelitian hukum empiris untuk mengecek langsung kenyataan di lapangan apakah hukum yang tertulis (Das Solen) sudah diterapkan dalam praktek sehari-hari (Das Sein) pada kasus satu tempat yaitu pada satu unit BUMDes di Desa Pajaran Kecamatan Poncokusumo Kab. Malang. Lebih lanjut Peneliti memberikan saran atas fakta lapangan yang ditemukan bahwa memang masih ada beberapa masalah walaupun masyarakat telah melakukanix sesuai dengan peraturan, sehingga perlu adanya peraturan yang lebih responsif untuk pemerintah ikut andil dalam memberikan bantuan kepada masyarakat.
English Abstract
The people's right to drinking water has been guaranteed by the state with Government Regulation Number 122 of 2015 that the Drinking Water Supply System (SPAM) is implemented to "fulfill" people's right to drinking water, whereas in the implementing regulations, namely the Minister of Public Works and Public Housing (PUPR) Regulation Number 27 of 2016 concerning the Implementation of SPAM explained in article 2 paragraph (2) uses a stronger diction which is "guaranteeing" people's right to drinking water. This research focuses on one article in the PUPR Ministerial Regulation, namely article 35 which explains the Basic Process Management of SPAM Implementation is carried out by community groups which in Article 33 of the Regulation states that the basic process of managing SPAM Management "adjusts" to the ability of the community. Researchers used empirical legal research methods to check directly the reality in the field whether the written law (Das Solen) has been applied in daily practice (Das Sein) in the case of one place, namely in one BUMDes unit in the Pajar Village, Poncokusumo District, Kab. Poor. The researcher further gave advice on the facts of the field which were found that there were indeed still some problems even though the community had carried out in accordance with the regulations, so the need for more responsive regulations for the government to take part in providing assistance to the community
