Abstract

Pasca berlakunya Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah kewenangan sektor pertambangan dipindahkan menjadi kewenangan pemerintah provinsi. Di dalam hal perizinan pertambangan tetap melibatkan pemerintah kabupaten dalam kesesuaian dengan Perda RTRW kabupaten/kota setempat. Tujuan dari penelitian ini adalah mendeskripsikan evaluasi Perda Kabupaten Bojonegoro Nomor 26 Tahun 2011 tentang RTRW Tahun 2011-2031 (studi tentang kawasan peruntukan pertambangan) yang menjadi pertimbangan dalam perizinan WIUP di pemerintah provinsi. Metode yang digunakan adalah kualitatif deskriptif dengan teknik pengumpulan datanya adalah wawancara, observasi dan dokumentasi. Sesuai Teknik pengumpulan data tersebut, hasil penelitian dari enam indikator evaluasi yang telah dikemukakan oleh William N. Dunn yaitu 1) efektivitas, Perda tersebut belum efektif karena sudah tidak sesuai. 2) efisiensi, tidak efisien karena ditemukan kawasan baru. 3) kecukupan, belum cukup menyelesaikan karena potensi tambang belum bisa dimaksimalkan. 4) perataan, dari segi manfaat kebijakan merata tapi jika untuk daerah yang berpotensi belum semuanya diakomodir. 5) responsivitas, respon dari masyarakat hanya dari masyarakat tambang. 6) ketepatan, Perda ini sudah tidak tepat karena sudah tidak sesuai dengan kondisi Kabupaten Bojonegoro sekarang. Jadi dapat disimpulkan bahwa evaluasi Perda RTRW Nomor 23 Tahun 2011 tahun 2011-2031 masih belum optimal terutama pasal kawasan peruntukan pertambangan. English Abstract

After the enactment of Law Number 23 Tahun 2014 concerning the Regional Government, the authority of the mining sector has been transferred to the authority of the provincial government. In the case of mining permits, the district government is still involved in conformity with the local regency/city RTRW regulation. The purpose of this study is to describe the evaluation of the Bojonegoro District Regulation Number 26 of 2011 on the 2011-2031 RTRW (the study of mining designation areas) which is a consideration in WIUP licensing in the provincial government. The method used is descriptive qualitative data collection techniques are interviews, observation, and documentation. The results of the study of the six evaluation indicators that have been put forward by William N. Dunn are 1) effectiveness, the regulation is not yet effective because it is not appropriate. 2) efficiency, not efficient because new areas were discovered. 3) adequacy, not enough to finish because the mining potential cannot be maximized. 4) leveling, in terms of the benefits of the policy evenly distributed but not all potential areas are accommodated. 5) responsiveness, the response from the community is only from the mining community. 6) accuracy, this regulation is not appropriate because it is not following the current condition of the Bojonegoro Regency. So it can be concluded that the evaluation of Regional Regulation on RTRW Number 23 of 2011 in 2011-2031 is still not optimal, especially in the area of mining allotment..
