Abstract
Penelitian ini membahas tentang Perbandingan Hukum Terhadap Tying Agreement Dalam Pasal 15 Ayat (2) Undang-Undang Nomor 5 Tahun 1999 Dengan Article 102 Huruf (d) The Treaty on the Functioning of the European Union. Permasalahan dalam penelitian ini adalah pengaturan tying agreement dalam ketentuan Pasal 15 ayat (2) Undang-Undang Nomor 5 Tahun 1999 termasuk ke dalam perjanjian tertutup sehingga dalam pembuktiannya tidak mempertimbangkan ada tidaknya pelaku usaha yang memiliki posisi dominan (ditinjau dengan pendekatan Per se Illegal), berbeda halnya dengan yang diatur di dalam Article 102 Huruf (d) The Treaty on the Functioning of the European Union (TFEU) yaitu suatu perbuatan tying agreement termasuk ke dalam perjanjian yang melanggar posisi dominan sehingga dalam pembuktiannya melihat adanya “effect” yang ditimbulkan dari perjanjian tying tersebut (ditinjau dengan pendekatan Rule Of Reason). Penelitian ini menggunakan jenis penelitian yuridis normatif dengan menggunakan metode pendekatan perundang-undangan (statute approach), pendekatan perbandingan (comparative opproach), dan pendekatan kasus (case approach). Dari hasil analisis yang dilakukan maka dapat diketahui bahwa untuk menilai suatu perbuatan tying agreement signifikan dapat mengganggu pasar maka pelaku usaha harus memiliki posisi dominan dan menyalahgunakannya karena tying agreement pada Pasal 15 Ayat (2) UU No. 5/1999 memiliki keterkaitan dengan Pasal 25 Ayat (1) a dan 25 Ayat (1) c UU No. 5/1999. Dengan demikian suatu perbuatan tying agreement secara signifikan mengganggu pasar jika pelaku usaha memiliki posisi dominan sebagaimana yang dimaksud pada Pasal 25 Ayat (2) UU No. 5/1999.
English Abstract
This study discusses the Legal Comparison of Tying Agreement in Article 15 Paragraph (2) of Law Number 5 of 1999 With Article 102 Letter (d) The Treaty on the Functioning of the European Union. The problem in this study is the regulation of tying agreement in the provisions of Article 15 Paragraph (2) of Law Number 5 of 1999 included in a exclusive dealing so that in the proof of not taking into account the presence or absence of business actors who have a dominant position (reviewed using the Per se Illegal approach), It is different from what is regulated in Article 102 letter (d) of the Treaty on the Functioning of the European Union (TFEU), which is an act of tying agreement including an agreement that violates the dominant position so that in its proof of seeing there is an "effect" arising from the tying agreement (reviewed with the Rule Of Reason approach). This research uses normative juridical research using the approach of legislation (statute approach), the comparative approach, and the approach of the case. From the results of the analysis conducted, it can be seen that in order to assess a tying agreement that can significantly disrupt the market, the business actor must have a dominant position and abuse it because of the tying agreement in Article 15 Paragraph (2) of Law Number 5 of 1999. Therefore, a tying agreement will significantly disrupt the market if the business actor has a dominant position as referred to in Article 25 Paragraph (2) of Law Number 5 of 1999.
