Abstract
Pada tesis ini, penulis mengangkat permasalahan berkaitan dengan hak cipta kreasi batik sebagai objek jaminan fidusia dalam perspektif hukum jaminan di Indonesia. Penulis mengambil judul ini dengan latar belakang bahwa masyarakat berhak untuk memperoleh kehidupan yang baik, memenuhi kebutuhannya dengan memanfaatkan ilmu pengetahuan, seni dan teknologi. Undang-Undang Tentang Hak Cipta mengatur bahwa hak cipta dapat dijadikan sebagai objek jaminan fidusia. Dalam pelaksanaannya, ternyata belum ada regulasi spesifik tentang hak cipta sebagai objek jaminan fidusia, kurangnya produk perbankan yang memfasilitasi hal ini serta melekatnya konsep jaminan fidusia konvensional dalam kredit perbankan. Berdasarkan hal-hal tersebut penulis mengangkat rumusan masalah: bagaimanakah pemetaan pengaturan hak cipta sebagai objek jaminan fidusia? Bagaimanakah konstruksi hukum hak cipta kreasi batik sebagai objek jaminan fidusia dalam perspektif hukum jaminan di Indonesia? Penulis dalam penulisan tesis ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan dan pendekatan konsep. Bahan hukum primer, sekunder, dan tersier yang didapatkan penulis dianalisa menggunakan teknik analisis interpretasi sistematis dalam menjawab tentang pemetaan pengaturan hak cipta sebagai objek jaminan fidusia; metode penemuan hukum dengan metode konstruksi hukum untuk menjawab tentang konstruksi hukum hak cipta kreasi batik sebagai objek jaminan fidusia. Dari hasil penelitian, ditemukan jawaban bahwa belum dibentuknya regulasi spesifik mengenai hak cipta sebagai objek jaminan fidusia dan hanya bertumpu pada Undang-Undang Jaminan Fidusia. Dikarenakan belum adanya regulasi yang spesifik, maka perlu diadakan konstruksi hukum hak cipta khususnya kreasi batik sebagai objek jaminan fidusia di Indonesia yang sesuai dengan Undang-Undang Hak Cipta dan Undang-Undang Jaminan Fidusia.
English Abstract
This research is based on understanding that every individual has rights to live a good life, to meet their need by means of knowledge, art, and technology. Law on Copyright regulates that the copyright can be used as fiduciary guarantee. In the implementation, there is no specific regulation concerning copyright as an object of fiduciary guarantee, and there is a lack of banking products that could facilitate this issue and banking products are still embedded to conventional fiduciary guarantee involved in lending by banks. The following research problems regarding the aforementioned issue are presented: how is the regulation of copyright as fiduciary guarantee mapped? And how is the legal construction for copyright of Batik set as fiduciary guarantee object based on the perspective of law regulating guarantee in Indonesia? This thesis writing employed normative juridical method with statute and conceptual approaches. The legal materials involved primary, secondary, and tertiary, all of which were analysed by performing systematic interpretation in order to give answer to the mapping concerning the regulation of fiduciary guarantee object, while the legal construction method was given regarding the legal construction for copyright of batik as fiduciary guarantee object. The research result reveals that there is no specific regulation that regulates copyright set as fiduciary guarantee object and the related case is only based on Law on Fiduciary Guarantee. As a result, it is regarded essential that the legal construction for copyright as fiduciary guarantee object in Indonesia, especially for batik products, be performed as referred to the Law on Copyright and Law of Fiduciary Guarantee.
