Abstract
Permasalahan yang diteliti dalam tesis ini adalah tentang 1) bagaimana ketentuan mengenai pemanfaatan tanah dalam kerjasama BOT, 2) apakah tanah Negara sama dengan tanah pemerintah dan 3) apakah alasan/ratio legis larangan menjaminkan tanah objek BOT berupa Barang milik Negara/Daerah. Tujuan penulis untuk mengadakan penelitian ini adalah untuk mengetahui dan menganalisis ketentuan pemanfaatan tanah dalam kerjasama BOT, untuk mengetahui perbedaan tanah Negara dengan tanah pemerintah, untuk mengetahui alasan/ratio legis larangan menjaminkan tanah objek BOT. Penelitian ini adalah penelitian preskriptif dengan pendekatan bersifat yuridis normatif dengan menggunakan pendekatan perundang-undangan dan konsep, teknik studi berupa studi kepustakaan yang kemudian dianalisis menggunakan Metode analisis Interprestasi sistematis. Kesimpulan dari penelitian ini adalah Ketentuan mengenai BOT telah diatur dalam PP No 27 Tahun 2014 Jo Permendagri 19 Tahun 2016 meskipun tidak secara tegas mengatur jenis hak penguasaan tanah. Tanah Negara tidaklah sama dengan tanah pemerintah sehingga terminologi barang milik Negara/daerah tidaklah tepat digunakan. Adapun ratio legis larangan menjaminkan objek BOT adalah bahwa objek BOT merupakan aset Negara dengan hak pengelolaan khusus. Berdasarkan hal tersebut seharusnya kerjasama BOT harus diatur secara jelas perumusannya dengan adanya regulasi khusus begitupula perlu adanya perubahan terminologi barang milik Negara yang kurang sesuai dengan konsep penguasaan Negara.
English Abstract
The problems examined in this thesis are 1) how is the provisions of land utilization in cooperation BOT, 2)Is State land the same as government land and 3)What is the reason for the prohibition on guaranteeing the land of BOT objects in the form of State / Regional Property? The author's purpose to conduct this research is to find out, analyze the provisions that apply to the BOT agreement, especially regarding the object of the agreement, so that it can be known the reason for the prohibition of guaranteeing the object and to find out the type of control of land rights according to Law No. 1 of 2004 concerning the State Treasury and its implementing regulations. This research is a prescriptive study with a normative juridical approach using a statutory approach and a conceptual approach by using document study techniques or literature studies which are then analyzed using the method of systematic interpretation analysis. That is an interpretation of the law as part of the entire legal system that links and connects one law to another. This method studies law by positioning the law as a system consisting of various subsystems / systematiche rechtswetenschap. The results of this research indicate that the provisions of BOT has been set in PP No 27 of 2014 Jo Peremendagri 19 of 2016 although not set clearly the type of land right. The provisions on land rights attached to it do not apply, in this research also found that state land is not the same as government land so that the terminology of state / regional property is not appropriate to use. BOT agreements are agreements that have special characteristics because there is an incision between public law, private law, and agrarian law. The reason for the prohibition on guaranteeing BOT objects is that BOT objects are State assets with special management rights. Based on that, the regulation regarding BOT cooperation should be clear with the law which specifically regulates the BOT agreement and including changes in the terminology of state property.
