Abstract

Malaysia merupakan salah satu negara yang masih menerapkan hukuman mati dan menjadi salah satu negara yang paling banyak menerapakan hukuman mati. Hal ini sebagian besar dipengaruhi oleh adanya pemahaman yang berbeda dalam penerapan hukuman mati di Malaysia yang mengakui penerapan hukuman mati. Selain itu, keabsenan pemerintah Malaysia dalam berbagai perjanjian HAM internasional membuat besarnya kemungkinan terjadinya unfair trial pada terpidana mati. Tingginya jumlah terpidana mati di Malaysia menunjukkan terjadinya pelanggaran hak asasi manusia yang cukup serius di negara tersebut. Penghapusan hukuman mati merupakan salah satu agenda HAM global saat ini. Hal ini karena penerapan hukuman mati melanggar hak hidup yang diatur dalam berbagai instrumen HAM internasional, seperti ICCPR (International Covenant on Civil and Political Rights) dan Declaration of Human Rights. Salah satu INGO yang mendorong penghapusan hukuman mati di Malaysia ialah Amnesty International. Menurut Amnesty International hukuman mati merupakan hukuman paling kejam, tidak manusiawi, dan merendahkan martabat manusia. Dalam penelitian akan dibahas mengenai taktik advokasi transnasional Amnesty International dalam mendorong penghapusan hukuman mati di Malaysia. Penelitian ini menggunakan jenis penelitian deskriptif dengan mengumpulkan data primer dan sekunder serta menggunakan konsep transnational advocacy networks milik Keck dan Sikkink. Hasil penelitian ini memperlihatkan upaya yang digunakan Amnesty International dalam advokasi ini antara lain information politics, symbolic politics, leverage politics dan accountability politics.

English Abstract

Malaysia is one of the countries that still applies the death penalty and one of the countries that has the most capital punishment. This is mostly influenced by the existence of different understandings in the application of the death penalty in Malaysia which recognizes the application of the death penalty. In addition, the absence of the Malaysian government in various international human rights treaties makes the possibility of an unfair trial on death row inmates. The high number of death row inmates in Malaysia shows that human rights violations are quite serious in that country. The abolition of the death penalty is one of the current global human rights agendas. This is because the application of the death penalty violates the right to life regulated in various international human rights instruments, such as the ICCPR (International Covenant on Civil and Political Rights) and the Declaration of Human Rights. One of the INGOs that encourages the abolition of the death penalty in Malaysia is Amnesty International. According to Amnesty International the death penalty is the ultimate cruel, inhuman and degrading punishment. The research will be discussed about Amnesty International's transnational advocacy tactics in encouraging the death penalty abolition in Malaysia. This research uses descriptive research by collecting primary and secondary data and using the concept of transnational advocacy networks by Keck and Sikkink. The results of this research show that the efforts used by Amnesty International in this advocacy include information politics, symbolic politics, leverage politics and accountability politics.
