Abstract
Ketika suatu negara tergabung ke dalam sebuah Perjanjian Internasional, maka negara terikat dengan peraturan yang ada dalam perjanjian tersebut. Namun tak jarang, negara melakukan pelanggaran terhadap peraturan dari Perjanjian Internasional yang sudah diratifikasi negara. Ketidakpatuhan negara terhadap Perjanjian Internasional bisa disebabkan oleh berbagai faktor. Dalam tulisan in penulis membahas mengenai faktor-faktor yang mempengaruhi tindakan tidak patuh Indonesia terhadap Pasal I GATT 1994 dalam sengketa BMTP produk besi dan baja tertentu asal Vietnam di Tahun 2018. Yang melalui analisis menggunakan teori Non-Complying Behavior dari Antonia Handler Chayes dan Abram Chayes dengan variabel Ambiguity, Limitations on Capacity (Capability), dan Temporal Dimension.
English Abstract
When a country becomes a part of an International Agreement, the said state is bound by the rules that exist within the Agreement. But sometimes there are cases where countries doesn’t comply with the rules that they had ratified. This non-compliance is usually caused by some factors. In this writing, the writer will explain the factors that lead to Indonesia’s non-compliance to Article I of GATT 1994 by imposing safeguard on certain iron and/or steel products from Vietnam in 2018. Which will be analyzed using Non-Complying Behavior theory from Antonia Handler Chayes and Abram Chayes with variables as such: Ambiguity, Limitations on Capacity (Capability), and Temporal Dimension .
