Abstract
Perkembangan teknologi pada saat ini berkembang pesat, hadirnya teknologi saat ini membantu manusia memudahkan aktivitasnya, salah satu bentuk dari perkembangan teknologi pada saat ini adalah online marketplace yang dapat membantu masyarakat melakukan transaksi online kapanpun dan dimanun, akan tetapi penggunaan sistem elektronik diberi batasan oleh Peraturan Pemerintah no 82 tahun 2012 agar sistem elekronik dan transaksi elektronik dilakukan dengan benar Penyelenggaran sistem elektronik dan transaksi elektronik diatur didalam Peraturan Pemerintah No 82 tahun 2012, didalam peraturan tersebut telah mengatur tata cara bertransaksi yang baik dan benar akan tetapi pada peraturan tersebut masih memiliki kekosongan hukum yaitu belum adanya sanksi bagi yang melanggar pasal 51 tentang kewajiban pada saat melakukan transaksi elektronik Sehingga peraturan tersebut cenderung untuk dilanggar pada saat melaksanakan transaksi elektronik. Karena identitas penjual dan pemberian informasi yang baik dan benar sangat diperlukan dalam melakukan transaksi elektronik, karena para pihak yang melakukan transaksi tidak bertemu secara langsung melainkan via online. Dalam penelitian ini penulis memfokuskan pada kekosongan hukum yang ada didalam Peraturan Pemerintah No 82 tahun 2012 dan Identitas penjual didalam online marketplace. Penelitian ini termasuk jenis penelitian yuridis normatif. Penelitian ini dilakukan dengan mengamati atau mengkaji peraturan perundangundangan atau dokumen terkait isu hukum dengan pendekatan Undang-Undang (Statue Approach). Bedasarkan pada kondisi demikian, dapat ditarik garis besar bahwa perlunya sanksi yang diterapkan pada pasal 51 Peraturan Pemerintah No 82 tahun vii 2012 agar dapat benar-benar mengikat dan memberikan sanksi kepada penjual yang tidak memberikan data dan informasi yang benar pada saat melakukan transaksi online
English Abstract
The development of technology is currently growing rapidly, the presence of technology today helps humans facilitate their activities, one form oftechnological development at this time is an online marketplace that can helppeople make online transactions, but the use of electronic systems is limited by Government Regulations 82 of 2012 so that the electronic anytime and anywheresystem and electronic transactions are carried out correctly The delivery of electronic systems and electronic transactions is regulated in Government Regulation No. 82 of 2012, in that regulation has set the procedure for good and correct transactions, but the regulation still has a legal vacuum that is not yet sanctions for violating article 51 regarding obligations when performing electronic transactions. So that it can have an impact on the application of the article when wanting to do electronic transactions. So that these regulations tend to be violated when carrying out electronic transactions. Because the seller's identity and the provision of good and correct information is very necessary in conducting electronic transactions, because the parties conducting the transaction do not meet in person but via online. In this study the authors focus on the legal vacuum in Government Regulation No. 82 of 2012 and the seller's identity in the online marketplace. This research is a type of normative juridical research. This research was conducted by observing or reviewing laws and regulations or documents related to legal issues using the Statue Approach. Based on these conditions, an outline can be drawn that the need for sanctions that are applied in Article 51 of Government Regulation No. 82 of 2012 in order to truly bind and impose sanctions on sellers who do not provide correct data and information when conducting online transactions
