Abstract

Kewajiban suami yang menceraikan istrinya telah diatur dalam pasal 149 Kompilasi Hukum Islam (KHI) yaitu berupa pembayaran nafkah iddah dan mut’ah serta nafkah yang lain. Namun pasal tersebut hanya mengatur tentang kewajiban suami yang menceraikan istrinya di Pengadilan Agama tanpa mengatur dengan pasti kapan kewajiban tersebut harus dibayarkan. Mahkamah Agung mengeluarkan pengaturan terkait masa pembayaran nafkah iddah dan mut’ah serta nafkah yang lain dalam sebuah Surat Edaran Mahkamah Agung (SEMA) Nomor 1 Tahun 2017 yaitu dengan memberikan penjelasan dapat dicantumkan dalam amar putusan dengan kalimat dibayar sebelum pengucapan ikrar talak. Tetapi dalam prakteknya, Hakim meanfsirkan berbeda terkait tujuan dikeluarkannya Surat Edaran Mahkamah Agung (SEMA) Nomor 1 Tahun 2017 tersebut. Hal ini dikhawatirkan akan menimbulkan ketidakadilan bagi istri yang dicerai talak oleh suaminya di Pengadilan Agama. Rumusan masalah dalam penelitian ini yakni apakah penafsiran Hakim pada Putusan Nomor 0006/Pdt.G/2018/PTA.Bjm da Putusan Nomor 1812/Pdt.G/2018/PA.Kab.Mlg telah sesuai dengan Surat Edaran Mahkamah Agung (SEMA) Nomor 1 Tahun 2017 tentang Pemberlakuan Rumusan Hasil Rapat Pleno Kamar Mahkamah Agung Tahun 2017? Jenis penelitian skripsi ini menggunakan metode yuridis normatif dengan pendekatan undang-undang (statute approach) dan pendekatan kasus (case approach). Peneliti menggunakan Putusan Nomor 0006/Pdt.G/2018/PTA.Bjm, Putusan Nomor 1812/Pdt.G/2018/PA.Kab.Mlg, dan beberapa undang-undang, literatur serta jurnal ilmiah yang dianalisis secara terperinci dengan teknik analisis interpretasi sistematis. Setelah menganalisis aturan hukum yang berlaku terkait masa pembayaran nafkah iddah dan mut’ah, serta meninjau dari metode penafsiran hakim pada beberapa putusan pada kasus yang sama, peneliti dapat menyimpulkan hasil berupa: Penafsiran hаkim dаlаm Putusan Nomor 0006/Pdt.G/2018/PTA.Bjm (Pembayaran Nafkah Iddah dan Mut’ah dilakukan Pada Saat Sidang Ikrar Talak dilaksanakan) dan Putusan Nomor 1812/Pdt.G/2018/PA.Kab.Mlg (Pembayaran Nafkah Iddah dan Mut’ah dilakukan Setelah Ikrar Talak dilaksanakan) tidаk sesuаi dengаn petunjuk pada Huruf C, angka 1, Surat Edaran Mahkamah Agung (SEMA) Nomor 1 Tahun 2017.

English Abstract

The obligation of a husband who divorces his wife has been regulated in article 149 of the Compilation of Islamic Law (KHI) in the form of payment of iddah and mut'ah and other means of living. However, this article only regulates the obligations of a husband who divorces his wife in the Religious Court without stipulating exactly when these obligations must be paid. The Supreme Court issued a regulation related to the payment period for iddah and mut'ah and other means of living in a Supreme Court Circular Letter (SEMA) Number 1 of 2017, namely by providing an explanation related to the payment period for iddah and mut'ah livelihoods that could be paid before the pronouncement of divorce pledge. But in practice, the judges mean different regarding the purpose of issuing the Supreme Court Circular Letter (SEMA) No. 1 of 2017. It is feared that this will lead to injustice for the wife divorced by divorce by her husband in the Religious Court. The formulation of the problem in this research is whether the interpretation of the Judge in Decision Number 0006 / Pdt.G / 2018 / PTA.Bjm da Decision Number 1812 / Pdt.G / 2018 / PA.Kab.Mlg is in accordance with the Supreme Court Circular Number (SEMA) Number 1 of 2017 concerning the Imposition of the Results of the 2017 Supreme Court Chamber Plenary Meeting? This type of research uses normative juridical methods with statute approach and case approach. Researchers used Decision Number 0006 / Pdt.G / 2018 / PTA.Bjm, Decision Number 1812 / Pdt.G / 2018 / PA.Kab.Mlg, and several laws, literatures and scientific journals that were analyzed in detail with interpretation analysis techniques. systematic. After analyzing the applicable legal rules related to the payment period of iddah and mut'ah, and reviewing the judge's interpretation method in several decisions in the same case, the researcher can conclude the results in the form of: Interpretation of justice in Decision Number 0006 / Pdt.G / 2018 / PTA .Bjm (Payment of Iddah and Mut'ah Livelihoods is carried out when the Talak Pledge Session is held) and Decision Number 1812 / Pdt.G / 2018 / PA.Kab.Mlg (Payment of Iddah and Mut'ah Livelihoods is carried out after the Talak Pledge Session is conducted) and Decision Number 1812 / Pdt.G / 2018 / PA.Kab.Mlg (Payment of Iddah and Mut'ah Livelihoods is carried out after the Talak Pledge Session is held) not in accordance with with instructions in Letter C, number 1, Supreme Court Circular Letter (SEMA) Number 1 of 2017.
