Abstract
Dalam Penulisan skripsi ini, penulis membahas mengenai Efektivitas Pasal 10 Ayat 4 Peraturan Pemerintah Nomor 74 Tahun 2014 Tentang Angkutan Jalan. Terkait kendaran roda dua dengan angkutan barang yang tidak sesuai standar ketentuan standar sepeda motor dengan angkutan barang yang sesuai pasal 10 ayat 4 bahwa “persyaratan teknis yang di maksud pada ayat (2)dua untuk sepeda motor meliputi: muatan tidak melebihi stang pengemudi, tinggi muatan tidak melebihi 900(Sembilan ratus) minimeter dari atsa tempat duduk pengemudi, dan barang muatan diletakan di belakang pengemudi.” Sering dilanggar oleh sebagian besar pengendara kendaran roda dua dengan angkutan barang, dan mengunakan angkutan barang yang tidak standar. Kemudian penulisan ini menggunakan jenis metode penelitian Yuridis Empiris dengan pendekatan sosiologis , penulis berusaha membuat penelitian yang menjawab permasalahan terkait dengan Efektifitas, Hambatan dan Upaya dalam Pasal 10 Ayat 4 Peraturan Pemerintah Nomor 74 Tahun 2014 Tentang xii Angkutan Jalan. Hasil dari penelitian ini menyimpulkan bahwa efektivitas terlihat dalam hasil wawancara terhadap responden yaitu pihak dinas perhubungan, pengendara kendaran roda dua dengan angkutan barang dan masyarakat yang sering berinteraksi dengan pengendara roda dua dengan angkutan barang sesuai dalam Pasal 10 Ayat 4 Peraturan Pemerintah Nomor 74 Tahun 2014 Tentang Angkutan Jalan tidak efektif. Adapun hambatan yang terjadi yaitu Peraturan Pemerintah tersebut hanya mengatur tentang persyaratan teknis (standar) roda dua dengan angkutan barang, namun tidak memiliki peraturan yang mendukung untuk menegakanya, pihak dinas perhubungan hanya di beri kewenangan untuk menindak pelangaran hanya di jembatan timbang dan terminal sedangkan angkutan barang dengan kendaraan roda dua tidak ada keharusan untuk memasuki dua tempat tersebut . Lebih lanjut Penulis merekomendasikan dibuatnya Peraturan dan atau Perundangan untuk mengatur sanksi bagi pelangaran kendaraan roda dua yang tidak sesuai standar.
English Abstract
The author of talking about the effectiveness of article 10 section 4 government regulation no 74 years 2014 about road vehicle. Related to the vehicle on two wheels transportation of goods that do not fit the standard provisions standard motorcycles with transportation of goods that accordance with article 10 section 4 that “ technical requirements in intent in paragraph ( 2 ) two for motorcycles covering: charge not to exceed the steering, driver high charge not to exceed 900 ( nine hundred ) millimeter from in the driver seat, and cargo were placed behind the driver”. The regulation is often violated by the majority of the vehicle riders on two wheels, transportation of goods and use transportation of goods that are not standard.Then using the writing of this kind of method juridical empirical research with the approach, sociological a writer trying to make research that the problems relating to the effectiveness of, obstacles and efforts to in article 10 section 4 government regulation no 74 years 2014 about road vehicle.The result of this study concluded that the effectiveness of seen in the interviews with respondents that is the transportation department, the rider of the vehicle on two wheels transportation of goods and the communities often interact with riders on xiv two wheels transportation of goods in accordance in article 10 section 4 government regulation no 74 years 2014 about road vehicle ineffective. The obstacles that there is government regulation was only about the requirements set technical standards ) ( two wheeled goods transport , but does not have the support to menegakanya , the transportation department only give authority to follow up pelangaran only in weigh bridges and terminal and transport goods with motorcycles there was no requirement to enter the two areas .Which recommended further writer or act to set rules and sanctions for pelangaran two wheeled vehicle that does not fit the standard
