Abstract
Dalam konflik internal antara pemerintah dan oposisi, upaya kudeta oleh pihak oposisi akan terjadi karena ketidakpuasan terhadap pemerintah dalam menjalankan fungsinya yang telah berlangsung lama atau penyalahgunaan kewenangan oleh pemerintah dengan memanfaatkan kekuasaannya sehingga merugikan negara. Pada saat pemimpin oposisi mendeklarasikan dirinya sebagai kepala Negara dan sebagian Negara lain mengakui statusnya sebagai kepala negara maka disebut pengakuan pemerintah baru, bahwa negara tersebut telah siap dan bersedia mengadakan hubungan dengan pemerintahan yang baru diakui sebagai organ yang bertindak untuk dan atas nama negaranya. Pengakuan yang diberikan oleh Amerika Serikat kepada Juan Guaido sebagai presiden sementara Venezuela dan menolak pengakuan terhadap Nicholas Maduro yang merupakan presiden terpilih Venezuela tentu memiliki akibat hukum mengingat pengakuan merupakan dasar dalam hukum internasional untuk dapat melakukan hubungan internasional. Berdasarkan hal diatas, karya tulis ini mengangkat rumusan masalah: (1) Apakah pengakuan Amerika Serikat kepada Juan Guaido sebagai Presiden Sementara Venezuela dapat dibenarkan menurut Hukum Internasional? (2) Bagaimana implikasi yuridis pengakuan Amerika Serikat kepada Juan Guaido sebagai presiden sementara Venezuela terhadap hubungan diplomatik antara Amerika Serikat dan Venezuela?. Penulisan karya tulis ini menggunakan metode Yuridis Normatif dengan metode pendekatan perundang-undangan dan pendekatan kasus. Dengan menggunakan metode diatas, penulis memperoleh jawaban bahwa pengakuan terhadap Juan Guaido oleh Amerika Serikat tidak dapat dibenarkan dalam Hukum Internasional. Pengakuan tersebut merupakan bentuk intervensi terhadap kemerdekaan politik Venezuela yang melanggar Pasal 2 ayat (4) Piagam PBB 1945. Pengakuan tersebut tidak memenuhi ketentuan-ketentuan mengenai pengakuan pemerintahan baru. Akibat hukum pengakuan Amerika Serikat kepada Juan Guaido sebagai presiden sementara Venezuela terhadap hubungan diplomatik antara Amerika Serikat dan Venezuela adalah terjadinya pemutusan hubungan diplomatik kedua negara, Venezuela memberikan status persona non grata kepada para diplomat Amerika Serikat di Venezuela dan memutuskan hubungan diplomatik dengan Amerika. Pemutusan hubungan diplomatik dengan Amerika serikat dapat dibenarkan menurut Konvensi Wina 1961 tentang Hubungan Diplomatik.
English Abstract
In an internal conflict between the government and the opposition, the coup attempt by the opposition will occur because of dissatisfaction with the government in carrying out its long-standing functions or abuse of authority by the government by utilizing its power to the detriment of the state. When the opposition leader declares itself as the head of the State and some other countries recognize their status as head of state, this is called the recognition of the new government, that the country is ready and willing to enter into relations with the newly recognized government as an organ acting for and on behalf of the country. The recognition given by the United States to Juan Guaido as Venezuela's interim president and to deny recognition of Nicholas Maduro who was elected president of Venezuela would have legal consequences because recognition is the basis in international law for international relations. Based on the above, this study raises the formulation of the problem: (1) Is the recognition of the United States of America to Juan Guaido as Interim President of Venezuela can be justified according to International Law? (2) What are the juridical implications of US recognition of Juan Guaido as Venezuela's interim president of diplomatic relations between the United States and Venezuela ?. This study uses the normative juridical method with the method of legislation and case approaches. By using the method above, the authors obtain the answer that the recognition of Juan Guaido by the United States cannot be justified in International Law. The recognition is a form of intervention against Venezuelan political independence in violation of Article 2 paragraph (4) of the UN Charter in 1945. The recognition does not fulfill the provisions concerning recognition of a new government. As a result of the legal recognition of the United States to Juan Guaido as Venezuela's interim president of diplomatic relations between the United States and Venezuela is the severing of diplomatic relations between the two countries, Venezuela grants non-grata persona status to US diplomats in Venezuela and sever diplomatic relations with America. Termination of diplomatic relations with the United States can be justified according to the 1961 Vienna Convention on Diplomatic Relations.
