Abstract

Penurunan populasi lumba-lumba di wilayah Eastern Tropical Pacific (ETP) mendorong Amerika Serikat untuk mengeluarkan sebuah peraturan mengenai label “dolphin-safe” untuk produk tuna yang dipasarkan di negaranya. Adanya penggunaan label tersebut membuat Meksiko merasa didiskriminasi dan dirugikan sehingga kemudian Meksiko melaporkan kasus tersebut ke World Trade Organization (WTO) pada tahun 2008. Dari gugatan Meksiko tersebut, WTO menyatakan bahwa Amerika Serikat telah melakukan ketidakpatuhan yaitu karena melanggar perjanjian Technical Barriers to Trade (TBT). Penulis ingin mengetahui bagaimana ketidakpatuhan yang dilakukan oleh Amerika Serikat dan apa yang menyebabkan ketidakpatuhan tersebut. Penulis meneliti fenomena tersebut dengan teori ketidakpatuhan dari Andrew T. Guzman yang dilihat berdasarkan adanya reputational sanction dan direct sanction.

English Abstract

The decline in the dolphin population in the Eastern Tropical Pacific region (ETP) prompted the United States to issue a regulation regarding the label "dolphin-safe" for tuna products marketed in the country. Mexico felt discriminated and treated unfairly by the use of this label, Mexico then reported the case to the World Trade Organization (WTO) in 2008. From the Mexican lawsuit, the WTO stated that the United States had committed non-compliance due to violating the Technical Barriers to Trade agreement (TBT ). The author wants to know how the non-compliance was done by the United States and what caused it. The author examines this phenomenon with Andrew T. Guzman's theory of non-compliance by examining the two variables; reputational sanction and direct sanction.
