Abstract
Penulis mengangkat permasalahan tentang Implementasi Pasal 3 Ayat (1) Peraturan Menteri Perhubungan Republik Indonesia No 33 Tahun 2018 tentang Pengujian Tipe Kendaraan Bermotor di Balai Pengujian Laik Jalan dan Sertifikasi Kendaraan Bermotor. Pilihan tema tersebut dilatarbelakangi banyaknya kendaraan bermotor roda empat yang melakukan modifikasi penggantian mesin dan di gunakan dijalan belum melaksanakan kewajiban uji tipe yang menyebabkan tidak baiknya penerapan peraturan pasal tersebut. Bedasarkan hal diatas, karya tulis ini mengangkat rumusan masalah : (1) Bagaimana implementasi Pasal 3 ayat (1) Peraturan Menteri Perhubungan Republik Indonesia Nomor 33 Tahun 2018 tentang Pengujian Tipe Kendaraan Bermotor terhadap Modifikasi penggantian mesin kendaraan bermotor roda empat di Balai Pengujian Laik Jalan dan Sertifikasi Kendaraan Bermotor? (2) Apa faktor-faktor yang menghambat dan upaya yang dilakukan dalam mengatasi hambatan pelaksanaan ketentuan terkait wajib uji tipe bagi modifikasi penggantian mesin kendaraan bermotor roda empat di Balai Pengujian Laik Jalan dan Sertifikasi Kendaraan Bermotor? Kemudian penulisan karya tulis ini menggunakan metode Yuridis Empiris dengan metode pendekatan Yuridis Sosiologis. Balai Pengujian Laik Jalan dan Sertifikasi Kendaraan Bermotor di jadikan lokasi studi penelitian karena merupakan lembaga yang berwenang melaksanakan uji tipe kendaraan di Indonesia. Data primer dan sekunder yang diperoleh Penulis akan diolah dengan teknik deskriptif kualitatif. Populasi dan sampel diperoleh dari petugas Balai Pengujian Laik Jalan dan Sertifikasi Kendaraan Bermotor serta masyarakat yang dalam hal ini adalah pelaku modifikasi kendaraan bermotor roda empat yang melakukan penggantian mesin Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa Pasal 3 Ayat (1) Peraturan Menteri Perhubungan Republik Indonesia No 33 Tahun 2018 tentang Pengujian Tipe Kendaraan Bermotor belum baik dalam pelaksanaannya di Balai Pengujian Laik Jalan dan Sertifikasi Kendaraan Bermotor, secara substansi hukum, penegakan dan pengawasan, sarana dan prasarana, dan masyarakat. Selain itu, Balai Pengujian Laik Jalan dan Sertifikasi Kendaraan Bermotor mengalami beberapa hambatan seperti subtansi peraturan perundang-undangan yang membuat persyaratan viii persyaratan Uji Tipe sulit dipenuhi, kewenangan pengawasan dan penegakan sanksi, terbatasnya fasilitas sarana uji tipe, rendahnya kesadaran masyarakat, dan sosialisasi yang tidak sempurna kepada masyarakat. Namun Balai Pengujian Laik Jalan dan Sertifikasi Kendaraan Bermotor telah melakukan upaya-upaya untuk mengatasi hambatan tersebut.
English Abstract
The author raised the issue about the Implementation of Article 3 Paragraph (1) of the Minister of Transportation's Regulation of the Republic of Indonesia No. 33 of 2018 concerning Testing of Motorized Vehicle Types at the Road Test and Motor Vehicle Certification Testing Center. The choice of the theme is motivated by the number of four-wheeled motorized vehicles that make modifications to engine replacement and are used on the road that have not carried out the type of test obligations that cause poor application of the rules of the article. Based on the above, this paper raises the formulation of the problem: (1) How is the implementation of Article 3 paragraph (1) of the Minister of Transportation Regulation of the Republic of Indonesia Number 33 of 2018 concerning Testing of Types of Motorized Vehicles on the replacement of fourwheeled motorized vehicle engines at the Roadworthiness Testing Center and Motor Vehicle Certification? (2) What are the inhibiting factors and efforts made in overcoming obstacles to the implementation of the relevant provisions that are required for type testing for the modification of the replacement of four-wheeled motorized vehicle engines at the Testing Center for Roadworthiness and Motor Vehicle Certification? Then the writing of this paper uses the Juridical Empirical method with the Sociological Juridical approach method. The Road Test and Motor Vehicle Certification Testing Center was made the location of the research study because it is an institution authorized to carry out vehicle type tests in Indonesia. Primary and secondary data obtained by the author will be processed with qualitative descriptive techniques. The population and samples were obtained from the officers of the Roadworthiness Test and Motor Vehicle Certification as well as the people who in this case were the perpetrators of the modification of four-wheeled motorized vehicles that carried out engine replacement. From the results of the research with the method above, the author obtained answers to the existing problems that Article 3 Paragraph (1) of the Minister of Transportation Regulation of the Republic of Indonesia No. 33 of 2018 concerning x Testing of Motorized Vehicles has not been well implemented in the Roadworthiness Testing and Motor Vehicle Certification Center. legal substance, enforcement and supervision, facilities and infrastructure, and the community. In addition, the Testing Center for Roadworthiness and Motor Vehicle Certification experienced several obstacles such as the substance of legislation that made requirements for Type Test requirements difficult to fulfill, the authority to supervise and enforce sanctions, the limited facilities of type testing facilities, low public awareness, and imperfect socialization to the community. However the Testing of Roadworthiness and Motor Vehicle Certification has made efforts to overcome these obstacles.
