Abstract
Diskusi mengenai pembentukan sebuah badan mekanisme HAM di kawasan Asia Tenggara bukan menjadi topik pembicaraan yang asing di organisasi regional ASEAN sejak lama. Sejak berdirinya pada tahun 1967, wacana mengenai pembentukan badan mekanisme HAM tersebut seringkali sudah menjadi wacana di setiap rapat pertemuan ASEAN. Meskipun terlambat 60 tahun dari Deklarasi HAM Universal yang dibentuk PBB, pada tahun 2009 akhirnya tercetuslah mandat pembentukan badan mekanisme HAM yang tertuang hitam di atas putih pada pasal 14 Piagam ASEAN. Lewat karya ilmiah ini penulis menjabarkan peran-peran AICHR sebagai organisasi Internasional dalam pemajuan dan perlindungan hak-hak asasi manusia pekerja migran di kawasan Asia Tenggara tahun 2010-2015. Isu yang dianalisis menggunakan konsep Peran Internasional milik Clive Archer ini terbagi atas tiga variable. Yaitu instrument, arena, dan actor. Instrument yang berarti alat atau sarana. Arena yang berarti fasilitas, dan actor yang berarti pembuat kebijakan atau pengimplementasi. Ketiga peran tersebut dipenuhi AICHR, meskipun belum cukup komprehensif untuk menjawab pertanyaan dari rumusan masalah penelitian ini. Namun dengan terpenuhinya ketiga variable kurang lebih sudah dapat menggambarkan komitmen AICHR sebagai badan mekanisme HAM antar-pemerintah ASEAN.
English Abstract
Discussions regarding the establishment of a human rights mechanism body in the Southeast Asia region have not been a topic of foreign conversation in ASEAN regional organizations for a long time. Since its establishment in 1967, the discourse on the establishment of a human rights mechanism body has often become a discourse at each ASEAN meeting. Even though it was 60 years late from the Universal Declaration of Human Rights established by the United Nations, in 2009 finally the mandate for the establishment of a human rights mechanism body was stated in article 14 of ASEAN Charter. Through this scientific work, the author describes the roles of the AICHR as an international organization in the promotion and protection of the human rights of migrant workers in Southeast Asia region in 2010-2015. The issues that analyzed using Clive Archer's Role of International Organizations concept are divided into three variables. Namely instruments, arenas, and actors. Instrument means the tool. Arena means the facility, and Actor means the policy maker or implementer. The three roles are fulfilled by AICHR, although it is not comprehensive enough to answer questions from the research problem formulation. But with the fulfillment of the three variables more or less it can already describe the AICHR's commitment as an inter-governmental human rights mechanism body of ASEAN.
