Abstract
Pasal 27 ayat (1) Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Uundang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi ElektronikTerhadap Pelaku Pelecehan Seksual via Media Sosial di Satreskrim Polres Malang Kota mengatur tentang perbuatan yang dilarang yaitu melakukan kegiatan pendistribusian dan/atau mentransmisikan dan/atau membuat dapat diaksesnya Informasi Elektronik dan/atau Dokumen Elektronik yang memuat hal yang melanggar asusila. Dalam beberapa tahun terakhir, grafik laporan kasus pelecehan seksual via media sosial terus meningkat, sedangkan pasal 27 ayat (1) Jo. Pasal 45 ayat (1) Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik seharusnya dapat digunakan untuk menanggulangi serta menjerat pelaku pelecehan seksual via media sosial namun pada praktiknya masih banyak pelaku yang lolos dari jeratan hukum. Maka terdapat permasalahan penerapan pasal 27 ayat (1) Jo. Pasal 45 ayat (1) Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik terhadap pelaku pelecehan seksual via media sosial. Jenis penelitian yang digunakan penulis dalam penelitian ini adalah yuridis empiris. Dari hasil penelitian penulis mendapatkan jawaban dari permasalahan penerapan pasal 27 ayat (1) Jo. Pasal 45 ayat (1) Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik ini terhadap pelaku pelecehan seksual via media sosial, bahwa ternyata dalam penerapannya pasal ini belum sepenuhnya berjalan dengan baik dan mengalami beberapa hambatan dalam penerapannya. Hambatan yang dihadapi oleh penyidik adalah sarana dan prasarana yang kurang memadai, penyidik sulit menemukan tersangka, penyidik sulit menentukan tersangka, kurangnya alat bukti yang ditemukan penyidik, hanya ada satu pasal yang dapat digunakan penyidik, dan saksi yang kurang kooperatif dalam membantu penyidik. Adapun upaya yang dilakukan penyidik untuk menanggulangi kendala tersebut adalah melakukan sosialisasi terkait pelecehan seksual, melakukan kerjasama dengan instansi lain, memberikan fasilitas khusus kepada saksi korban, menggunakan hasil screenshoot disertai hasil analisis dari ahli digital forensik, memberikan pelatihan dalam bidang teknologi informasi kepada petugas, menerapkan Pasal 27 ayat (1) Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik terhadap Tersangka.
English Abstract
Article 27 paragraph (1) of Law Number 19 of 2016 concerning Amendments to Laws Number 11 of 2008 concerning Information and Electronic Transactions Against Perpetrators of Sexual Harassment via Social Media in Malang City Polres Satreskrim regulates acts that are prohibited namely distribution and / or transmit and / or make accessible Electronic Information and / or Electronic Documents containing things that violate immorality. In recent years, the graph of reports of cases of sexual abuse via social media continues to increase, while article 27 paragraph (1) Jo. Article 45 paragraph (1) of Law Number 19 Year 2016 concerning Amendments to Law Number 11 Year 2008 concerning Information and Electronic Transactions should be used to overcome and ensnare sexual harassers via social media but in practice there are still many perpetrators who escape legal entanglement. Then there are problems implementing article 27 paragraph (1) Jo. Article 45 paragraph (1) of Law Number 19 Year 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions against sexual harassers via social media. The type of research used by the author in this study is empirical juridical. From the results of the study the authors get answers to the problems of applying article 27 paragraph (1) Jo. Article 45 paragraph (1) of Law Number 19 Year 2016 concerning Amendments to Law Number 11 Year 2008 concerning Information and Electronic Transactions against sexual harassers via social media, that it turns out that in this application this article has not fully run properly and has experienced some obstacles in its application. Obstacles faced by investigators are inadequate facilities and infrastructure, investigators have difficulty finding suspects, investigators find it difficult to determine suspects, lack of evidence found by investigators, there is only one article that can be used by investigators, and witnesses who are less cooperative in assisting investigators. The efforts carried out by investigators to overcome these obstacles were to carry out socialization related to sexual harassment, collaborate with other agencies, provide special facilities to victim witnesses, use the results of screenshots accompanied by analysis results from digital forensic experts, provide training in information technology to officers, implement Article 27 paragraph (1) of Law Number 19 Year 2016 concerning Amendments to Law Number 11 Year 2008 concerning Information and Electronic Transactions of Suspects.
