Abstract
Pada skripsi ini penulis mengangkat permasalahan Pengaturan Terhadap Izin Usaha Food Truck di Kota Malang Yang Belum Memiliki Payung Hukum dan Membandingkannya Dengan Peraturan Gubernur Provinsi DKI Jakarta Nomor 13 Tahun 2017 tentang Restoran Bergerak Yang Sudah Lebih Dahulu Memiliki Payung Hukum Terhadap Usaha Food Truck Berdasarkan hal tersebut diatas, penelitian ini mengangkat rumusan masalah : (1) Bagaimana perbedaan pengaturan terkait izin usaha food truck di DKI Jakarta dan Kota Malang ? (2) Apa urgensi dari pengaturan izin usaha food truck di Kota Malang ? Kemudian, penelitian ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statue approach) dan pendekatan perbandingan (comparative approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis akan dianalisis dengan menggunakan penafsiran gramatikal dan penafsiran sosiologis. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa Pelaku usaha foodtruck di Kota Malang yang menggunakan kendaraan roda empat tersebut yang menjadi permasalahan bagi pemerintah Kota Malang dikarenakan para pelaku usaha atau PKL tersebut kebanyakan tidak memiliki izin usaha perdagangan dan izin-izin yang lainnya dan tidak adanya payung hukum terhadap usaha food truck. Peraturan Daerah Kota Malang Nomor 1 Tahun 2000 tentang Pengaturan Dan Pembinaaan Pedagang Kaki Lima juga belum efektif dalam melaksanakan suatu aturan terhadap food truck itu sendiri karena yang sifatnya masih baku dan belum menentukan jenis food truck kedalam kategori yang berbeda dengan PKL, sedangkan food truck itu mencangkup banyak hal, aspek dan tidak bisa disamakan dengan Pedagang Kaki Lima.
English Abstract
In this paper the author raises the issue of regulation of food truck business licenses in Malang City that do not yet have legal regulations and compares them with the regulation of DKI Jakarta Governor No. 13 of 2017 concerning the transfer of restaurants that are legally regulated for the food truck business. Based on the above, this research raises the formulation of the problem: (1) How are the different arrangements related to the business permit for food trucks in DKI Jakarta and Malang City? (2) What is the urgency of setting up a business permit for food trucks in Malang City? Then this thesis using methods of juridical normative approach to statutory methods (statue approach) and comparative approach (comparative approach). The primary legal materials, secondary, and tertiary that earned by author will be analyzed by using grammatical interpretation and sociological interpretation. From the results of the research with the method above, the author obtained answers to the existing problems that food truck businessmen in Malang City who use four-wheeled vehicles are a problem for the Malang City government because most business people or street vendors do not have trading business licenses and permits other permissions and the absence of legal rules for food truck businesses. The Regional Regulation of Malang City Number 1 of 2000 concerning Arrangement and Development of Street Vendors has also not been effective in implementing a rule for the food truck itself because the nature is still standard and has not determined the type of food truck into different categories with Street Vendors, while food truck it covers many things, aspects and cannot be equated with Street Vendors.
