Abstract
Di Indonesia telah hadir beberapa penyedia jasa ojek berbasis aplikasi yang dapat dipesan secara online, salah satu contohnya yaitu jasa transportasi dari PT Aplikasi Karya Anak Bangsa yang disingkat AKAB menerbitkan sebuah aplikasi yaitu GO-JEK. Transportasi ojek berbasis online diatur dalam Peraturan Menteri Perhubungan Nomor 12 Tahun 2019 Tentang Perlindungan Keselamatan Pengguna Sepeda Motor Yang Digunakan Untuk Kepentingan Masyarakat. Tetapi permasalahan mengenai tarif minimum yang masih terus difinalisasi belum mencapai titik temu diantara pemerintah, aplikator, dan mitra driver. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum terhadap mitra driver terkait kesepakatan tarif minimum dalam perjanjian kemitraan PT Aplikasi Karya Anak Bangsa pada aplikasi GO-JEK dan untuk menganalisis pengaturan penentuan tarif minimum pada perjanjian kemitraan menurut Peraturan Mentri Perhubungan Nomor 12 Tahun 2019. Penelitian ini menggunakan metode penelitian hukum yuridis normatif dengan metode pendekatan statue approach dan conseptual approach. Dan teknik analisis bahan hukum akan diinterpretasikan menggunakan metode interpretasi sistematis dan gramatikal. Penelitian ini membahas mengenai perjanjian kemitraan yang dibuat oleh PT Aplikasi Karya Anak Bangsa belum melindungi mitra driver GO-RIDE. Perjanjian kemitraan yang bentuk perjanjiannya model baku ini dirasa oleh mitra driver GO-RIDE tidak adil dan merugikan. Sehingga menuntut PT Aplikasi Karya Anak Bangsa meninjau ulang kembali perjanjian kemitraan yang seharusnya menerapkan asas keseimbangan. Permasalahan driver ojek online mengenai tarif yang belum adanya payung pemerintah mencari solusi dengan mengeluarkan Peraturan Mentri Perhubungan Nomor 12 Tahun 2019 secara terpisah peraturan mengenai tarif dikeluarkan pada Keputusan Menteri Perhubungan Nomor 348 Tahun 2019, akan tetapi melalui peraturan tersebut penetapan tarif diatur oleh Menteri, sehingga aplikator dan mitra driver GO-RIDE tidak mempunyai kesempatan untuk menyampaikan tarif yang diinginkan. Oleh karena itu terdapat dua bentuk perlindungan hukum yaitu perlindungan hukum preventif dan perlindungan hukum represif.
English Abstract
In Indonesia, there are already a number of application-based motorcycle taxi service providers that can be ordered online, one example of which is transportation services from PT Karya Anak Bangsa application, abbreviated as AKAB, which publishes an application, GO-JEK. Online-based motorcycle taxi transportation is regulated in the Minister of Transportation Regulation Number 12 of 2019 concerning the Safety Protection of Motorcycle Users Used in the Interest of the Community. But the problems regarding the minimum tariffs that are still being finalized have not yet reached a meeting point between the government, applicators and driver partners. This study aims to analyze the form of legal protection against driver partners related to the minimum tariff agreement in the PT Aplikasi Karya Anak Bangsa partnership agreement on the GO-JEK application and to analyze the minimum tariff setting in the partnership agreement according to the Minister of Transportation Regulation Number 12 of 2019. This study uses a normative juridical legal research method with the statue approach and conseptual approach method. And legal material analysis techniques will be interpreted using systematic and grammatical interpretation methods. This study discusses the partnership agreement made by PT Karya Anak Bangsa application not to protect GO-RIDE driver partners. The partnership agreement that forms the agreement of this standard model is perceived by GO-RIDE driver partners as unfair and detrimental. So that requires PT Aplikasi Karya Anak Bangsa to review the partnership agreement that should apply the principle of balance. The issue of online motorcycle taxi drivers regarding tariffs that have no umbrella, the government is seeking a solution by issuing Transportation Minister Regulation Number 12 Year 2019 separately regarding the tariff regulation issued in Decree of the Minister of Transportation Number 348 of 2019, but through this regulation tariff regulation is regulated by the Minister, so that applicators and GO-RIDE driver partners do not have the opportunity to deliver the desired rate. Therefore there are two forms of legal protection, namely preventive legal protection and repressive legal protection.
