Abstract
Penelitian ini membahas mengenai Pelaksanaan Hukuman Disiplin Bagi Aparat Tenaga Pendukung Operasional Kegiatan (TPOK) Yang Melakukan Perjanjian Kerja Di Satuan Polisi Pamong Praja Kota Malang (Studi Kasus Kontrak Kerja Di Satuan Polisi Pamong Praja Kota Malang). Berdasarkan fakta, bahwa pada instansi Satuan Polisi Pamong Praja Kota Malang dalam pemberian hukuman disiplin terhadap pegawai aparat Tenaga Pendukung Operasional Kegiatan memberikan hukuman disiplin sama halnya dengan pemberian hukuman disiplin terhadap pegawai aparat PNS dalam Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin PNS, secara yuridis dalam Undang-Undang Nomor 05 Tahun 2014 tentang Aparatur Sipil Negara bahwa Pegawai Negeri Sipil dan Tenaga Pendukung Operasional Kegiatan adalah berbeda dari segi hak, kewajiban, tugas dan status pegawai dalam pemerintahan, Tenaga Pendukung Operasional lebih identik dengan Pegawai Pemerintah Dengan Perjanjian Kerja. Oleh sabab itu segala sesuatu berkaitan dengan penegakan disiplin dan pemberhentian atau pemutusan hubungan perjanjian kerja bagi pegawai TPOK dapat mengacu pada aturan yang berlaku bagi pegawai PPPK, yang tertera didalam Pasal 104 dan Pasal 105 Undang-Undang Nomor 05 Tahun 2004 tentang Aparatur Sipil Negara. Berdasarkan latar belakang tersebut, maka rumusan masalah dalam penelitian ini adalah (1) Bagaimana pelaksanaan hukuman disiplin bagi apratur Tenaga Pendukung Operasional Kegiatan (TPOK) yang melakukan perjanjian kerja di Satuan Polisi Pamong Praja Kota Malang? (2) Apa hambatan dan solusi yang tepat dalam pelaksanaan hukuman disiplin bagi apratur Tenaga Pendukung Operasional Kegiatan (TPOK) yang melakukan perjanjian kerja di Satuan Polisi Pamong Praja Kota Malang? Penelitian menggunakan jenis yuridis empiris dengan metode pendekatan yuridis sosiologis. Lokasi penelitian dilakukan di instansi Satuan Polisi Pamong Praja Kota Malang. Jenis dan Sumber data adalah data primer dan data sekunder. Data Primer dapat diperoleh dengan melakukan wawancara langsung dengan narasumber. Data sekunder diperoleh dati studi kepustakaan, pendapat dari para ahli hukum dan studi internet. Teknik analisa data adalah deskriptif kualitatif. Dari hasil penelitian ini dapat diketahui, bahwa terdapat ketidak jelasan dalam pemberian hukuman disiplin terhadap pegawai aparat Tenaga Pendukung Operasional Kegiatan dalam instansi Satuan Polisi Pamong Praja Kota Malang.
English Abstract
This study discusses the Implementation of Discipline Penalties for the Operational Supporting Personnel (TPOK) who Conduct Work Agreements in the Malang City Civil Service Police Unit (Case Study of Work Contracts in the Malang City Civil Service Police Unit). Based on the fact, that in the agency of the Malang City Civil Service Police Unit in giving disciplinary penalties to employees of the Operational Supporting Personnel Activities giving disciplinary punishments is the same as giving disciplinary penalties to employees of civil servants in Government regulation number 53 of 2010 concerning diplomatic civil servants, juridically in Law Number 05 of 2014 concerning The State Civil Apparatus that Civil Servants and Operational Supporting Personnel Activities are different in terms of rights, obligations and status of employees in government, Operational Supporting Personnel is more synonymous with Government Employees with Work Agreements. By that, everything related to disciplinary enforcement and termination or termination of employment agreements for TPOK employees refers to the rules that apply to first aid workers, as stated in Article 104 and Article 105 of Act Number 05 of 2004 concerning State Civil Apparatus. Based on this background, the formulation of the problem in this study is (1) How is the implementation of disciplinary penalties for the activities of the Operational Supporting Staff (TPOK) who make work agreements at the Malang City Civil Service Police Unit? (2) What are the right obstacles and solutions in implementing disciplinary penalties for the activities of the Operational Supporting Staff (TPOK) who make work agreements at the Malang City Civil Service Police Unit? he study used an empirical juridical method with a sociological juridical approach method. The location of the study was conducted in the agency of the Malang City Civil Service Police Unit. Types and Sources of data are primary data and secondary data. Primary data can be obtained by conducting direct interviews with the speakers. Secondary data was obtained from library studies, opinions from legal experts and internet studies. The data analysis technique is qualitative descriptive. From the results of this study, it can be seen, that there is a lack of clarity in giving disciplinary punishment to employees of the Operational Supporting Activity Staff in the Malang City Civil Service Police Unit
