Abstract
Penelitian ini membahas tentang efektivitas pelaksanaan Rencana Induk Pengelolaan Sampah Rumah Tangga (Studi Pasal 7 ayat (2) huruf a Peraturan Daerah Kabupaten Gresik Nomor 5 Tahun 2017. Berdasarkan fakta, bahwa volume sampah rumah tangga di Kabupaten Gresik cukup besar dan TPA Kabupaten Gresik sudah melebihi kapasitas. Volume sampah rumah tangga di Kabupaten Gresik cukup besar karena tidak ada keseimbangan antara peraturan, penegak hukum, sarana atau fasilitas, masyarakat dan kebudayaan dengan sistem pelaksanaan rencana induk pengelolaan sampah rumah tangga. Berdasarkan latar belakang tersebut, maka rumusan masalah pada penelitian ini adalah (1) Bagaimana efektivitas Pasal 7 ayat (2) huruf a Peraturan Daerah Kabupaten Gresik Nomor 5 Tahun 2017 Tentang Pengelolaan Sampah Terkait Rencana Induk Pengelolaan Sampah Rumah Tangga? (2) Apa saja faktor – faktor yang menjadi penghambat pelaksanaan rencana induk pengelolaan sampah rumah tangga terhadap efektivitas Pasal 7 ayat (2) huruf a Peraturan Daerah Kabupaten Gresik Nomor 5 Tahun 2017 tentang Pengelolaan Sampah? Penelitian ini menggunakan jenis penelitian yuridis empiris dengan metode pendekatan yuridis sosiologis. Lokasi penelitian di Bidang Pengelolaan Kebersihan Dinas Lingkungan Hidup Kabupaten Gresik. Jenis dan Sumber data adalah data primer dan data sekunder. Data primer dapat diperoleh dengan melakukan wawancara langsung dengan narasumber. Data sekunder diperoleh dari studi kepustakaan, pendapat dari ahli hukum dan studi internet. Teknik analisa data adalah deskriptif kualitatif. Dari hasil penelitian ini dapat diketahui, bahwa efektivitas Pasal 7 ayat (2) huruf a Peraturan Daerah Kabupaten Gresik Nomor 5 Tahun 2017 tentang Pengelolaan Sampah terkait dengan sistem pelaksanaan Rencana Induk Pengelolaan Sampah Rumah Tangga belum berjalan efektif. Terdapat beberapa faktor yang menyebabkan sistem pelaksanaan rencana induk pengelolaan sampah rumah tangga di Kabupaten Gresik belum berjalan efektif, yaitu faktor penegak hukum, faktor sarana atau fasilitas yang mendukung penegakan hukum, faktor masyarakat, faktor kebudayaan.
English Abstract
This study discusses the effectiveness of the Master Plan for Household Waste Management (Study Article 7 paragraph (2) letter a Regional Regulation of Gresik Regency Number 5 of 2017. Based on the fact, the volume of household waste in Gresik Regency is quite large and the Gresik Regency landfill has exceeded capacity The volume of household waste in Gresik Regency is quite large because there is no balance between regulations, law enforcement, facilities or facilities, the community and culture with a system for implementing the household waste management master plan. Based on this background, the formulation of the problem in this study are (1) How is the effectiveness of Article 7 paragraph (2) letter a Regional Regulation of Gresik Regency Number 5 of 2017 concerning Waste Management Related to the Master Plan for Household Waste Management? (2) What are the factors that inhibit the implementation of the master plan for managing household waste against the effectiveness of Article 7 paragraph (2) letter a Regional Regulation of Gresik Regency Number 5 of 2017 concerning Waste Management? This study uses a type of juridical empirical research with a sociological juridical approach method. Research location in the Field of Hygiene Management of the Environmental Agency of Gresik Regency. Types and Sources of data are primary data and secondary data. Primary data can be obtained by conducting direct interviews with the speakers. Secondary data was obtained from library studies, opinions from legal experts and internet studies. The data analysis technique is qualitative descriptive. From the results of this study, it can be seen that the effectiveness of Article 7 paragraph (2) letter a of the Regional Regulation of Gresik Regency Number 5 of 2017 concerning Waste Management related to the implementation of the Master Plan for Household Waste Management has not been effective. There are several factors that have caused the system to implement the master plan for household waste management in Gresik Regency to be effective, namely law enforcement factors, facilities or facilities that support law enforcement, community factors, cultural factors.
