Abstract
Pada skripsi ini penulis mengangkat permasalahan Penulisan Sumber Berita oleh News Aggregator berdasarkan Pasal 43 Huruf C Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Pilihan tema tersebut dilatar belakangi oleh ketidak jelasan batasan makna kata “lengkap” terkait penulisan sumber berita oleh News Aggregator. Berdasarkan hak tersebut diatas, penelitian ini mengangkat rumusan masalah: (1) Аpаkаh News Аggregаtor berbentuk Feed Aggregator melаnggаr Undаng-Undаng Nomor 28 Tаhun 2014 tentаng Hаk Ciptа terkаit pengаmbilаn dan menampilkan Beritа? (2) Apakah batasan makna kata “lengkap” dalam Pasal 43 huruf c Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta? Kemudian, penelitian ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan (statue approach) dan pendekatan perbandingan (comparative approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis akan dianalisis dengan menggunakan penafsiran gramatikal. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa berita sebagai salah satu bentuk ciptaan. Dimana dalam pengambilan dan menampilkan berita oleh News Aggregator berbentuk Feed Aggregator, dengan memperhatikan pasal 43 huruf c dan pasal 48 UU Hak Cipta. Selain dengan menuliskan sumbernya secara lengkap yang berikaitan dengan hak moral, dalam menampilkan berita juga harus memperhatikan hak ekonomi pencipta atau pemegang hak cipta, yaitu dengan izin. Serta batasan makna lengkap diperoleh sebagaimana didukung oleh peraturan-peraturan lain dan dapat disimpulkan bahwa batasan makna kata “lengkap” dalam penulisan sumber berita setidak-tidaknya berisi, Nama Pencipta atau Penulis berita, Nama Media atau Kantor Berita darimana berita berasal, Waktu dikeluarkannya berita, atau waktu penerbitan berita sejak pertama kali diumumkan kepada publik, serta sumber link menuju halaman berita asli. Dengan kata lain bahwa penulisan sumber secara “lengkap” haruslah dirasa bersifat jelas dan lengkap.
English Abstract
In this research authors want to try elucidate about The Writing of News Sources by News Aggregator based on Article 43 (C) Act 28 of 2014 on Copyright. The theme selection is based on lack of clarity of limitation terms “complete” about writing the news sources by News Aggregator. Regarding this issue, authors try to elucidate identification of the problem : (1) Is the News Aggregator in the form of a Feed Aggregator breaking the Copyright Act? (2) The limitation of the terms “complete” in article 43 (C) Act 28 of 2014 on Copyright? Then this research using methods of juridical normative approach to statutory methods (statue approach) and comparative approach (comparative approach). The primary legal materials, secondary, and tertiary that earned by author will be analyzed by using grammatical interpretation. From the results of the research with the method above, the author gets answers to the existing problems that the news as one form of creation. Where in the retrieval and display of news by the News Aggregator in the form of Feed Aggregator, taking into account article 43 letter c and article 48 of the Copyright Act. In addition to writing the source in full, which is related to moral rights, in presenting the news, it must also pay attention to the economic rights of the creator or the copyright holder, namely by permission. As well as the limitations of the full meaning of the retrieved as supported by other regulations and can be concluded that the limitation of the meaning of the word "complete" in the writing of news sources made up, the name of the Creator or author Name, News Media or News Agency where the news comes from, the time of issue of news, publishing news or time since first announced to the public, as well as the source of the link to the news page.
