Abstract
Pada skripsi ini, penulis mengangkat permasalahan efektivitas pasal 106 ayat (1) Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan mengenai kewajiban mengemudikan kendaraan bermotor dengan wajar dan penuh konsentrasi. Pilihan tema tersebut dilatarbelakangi karena masyarakat atau pengemudi kendaraan bermotor di Kota Malang masih sering melakukan pelanggaran-pelanggaran terhadap aturan yang berlaku seperti aturan terkait mengemudikan kendaraan bermotor dengan wajar dan penuh konsentrasi yang dapat menyebabkan kemacetan hingga kecelakaan. Berdasarkan hal tersebut diatas, penelitian ini mengangkat rumusan masalah: (1) Bagaimana efektivitas Pasal 106 ayat (1) Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan? (2) Apa saja hambatan-hambatan pihak Kepolisian Satuan Lalu Lintas Kota Malang dalam mengefektifkan Pasal 106 ayat (1) Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan? (3) upaya-upaya apa saja yang dilakukan oleh Pihak Kepolisian Satuan Lalu Lintas Kota Malang untuk mengatasi hambatan-hambatan yang terjadi dalam mengefektifkan Pasal 106 ayat (1) Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan ? Untuk menjawab permasalahan diatas, penelitian yuridis empiris ini menggunakan pendekatan yuridis sosiologis. Jenis dan Sumber data penelitian ini yaitu data primer yang diperoleh melalui wawancara langsung dengan narasumber yaitu pihak kepolisian Satlantas Polres Kota Malang dan penyebaran kuesioner kepada masyarakat atau pengemudi kendaraan bermotor di Kota Malang dan data sekunder yang diperoleh dari peraturan perundang-undangan, dokumen resmi, buku-buku dan internet. Data yang telah diperoleh dianlaisis dengan menggunakan metode deskriptif kualitatif yaitu dengan mengumpulkan data yang diperoleh dari penelitian kemudian dianalisis guna menjawab masalah hukum yang telah dirumuskan. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa efektivitas Pasal 106 ayat (1) Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan belum efektif. Hal ini disebabkan karena faktor struktur hukumnya yaitu pihak Kepolisian Satuan Lalu Lintas Kota Malang kekurangan petugas untuk selalu melakukan pengawasan terhadap pelanggaran yang tidak berkonsentrasi saat berkendaraan bermotor dan faktor budaya hukum yaitu perilaku masyarakat itu sendiri yang kurang sadar akan hukum. Dengan demikian, diharapkan pihak Kepolisian untuk dapat mengoptimalkan perannya dalam melakukan sosialisasi, penindakan dan pengawasan, juga diharapkan Pemerintah Kota Malang dapat menyediakan sarana atau fasilitas untuk mendukung penegakan hukum pihak Kepolisian dan diharapkan masyarakat meningkatkan rasa kesadaran diri terhadap aturan hukum yang berlaku.
English Abstract
In this paper, the author raises the issue of the effectiveness of article 106 paragraph (1) of Law Number 22 Year 2009 concerning Road Traffic and Transportation regarding the obligation to drive motorized vehicles in a reasonable and concentrated manner. The choice of the theme was motivated because the people or drivers of motorized vehicles in the city of Malang still often commit violations of the applicable rules such as the rules relating to driving motor vehicles in a reasonable and full concentration that can cause congestion to accidents. Based on the above, this study raises the formulation of the problem: (1) How is the effectiveness of Article 106 paragraph (1) of Law Number 22 Year 2009 concerning Road Traffic and Transportation? (2) What are the obstacles for the Police of the Malang City Traffic Unit in streamlining Article 106 paragraph (1) of Law Number 22 Year 2009 concerning Road Traffic and Transportation? (3) what efforts have been made by the Police of the Malang City Traffic Unit to overcome the obstacles that occur in effective Article 106 paragraph (1) of Law Number 22 Year 2009 concerning Road Traffic and Transportation? To answer the above problems, this empirical juridical research uses a sociological juridical approach. The types and sources of this research data are primary data obtained through direct interviews with informants, namely Malang City Police Satlantas police and distributing questionnaires to the public or motorized vehicle drivers in Malang City and secondary data obtained from legislation, official documents, books books and internet. The data that has been obtained is analyzed using a qualitative descriptive method that is by collecting data obtained from the study then analyzed to answer the legal problems that have been formulated. From the results of the research with the method above, the author obtained answers to the existing problems that the effectiveness of Article 106 paragraph (1) of Law Number 22 of 2009 concerning Road Traffic and Transportation has not been effective. This is due to the legal structure factor, namely the Malang City Traffic Unit Police lack of officers to always monitor violations that do not concentrate when motorized driving and legal culture factors, namely the behavior of the people themselves who are less aware of the law. Thus, it is expected that the Police can optimize its role in conducting socialization, prosecution and supervision, also expected that the City Government of Malang can provide facilities or facilities to support the law enforcement of the police and it is hoped that the community will increase their sense of self-awareness towards the applicable law.
