Abstract
Salah satu instrument dalam penyelenggara pemerintah daerah adalah DPRD yang merupakan lembaga perwakilan rakyat daerah. DPRD mempunyai Fungsi Legislasi yang dijalankan bersama Kepala Daerah. Fungsi legislasi DPRD adalah fungsi pembentukan peraturan daerah bersama kepala daerah yang harus berpedoman sebagaimana telah diatur dalam UU Nomor 12 Tahun 2011 Tentang Pembentukan Pertauran Perundang-undangaan. Untuk menjalankan fungsinya tersebut Anggota DPRD juga memiliki hak-hak tertentu, salah satunya adalah Hak Inisiatif sebagai hak mengajukan rancangan peraturan daerah.Peraturan daerah merupakan salah satu instrumen penting dalam pemerintahan daerah dimana Peraturan Daerah mengatur muatan lokal kekhususan daerah yang tidak diatur dalam Undang-Undang. Pada tahun 2013 DPRD Kabupaten Sukoharjo memiliki hak inisiatif yang tinggi. Namun pada tahun 2014-2017 penggunaan hak inisiatif DPRD Kabupaten Sukoharjo menurun drastis. Tujuan penelitian ini adalah untuk mengetahui dan menganalisis pelaksanaan fungsi legislasi DPRD Kabupaten Sukoharjo. Penelitian ini merupakan penelitian deskriptif dengan pendekatan kualitatif. Lokasi penelitian di Dewan Perwakilan Rakyat Daerah Kabupaten Sukoharjo. Dalam penelitian ini dibatasi oleh dua fokus penelitian yaitu (1) Peran fungsi legislasi DPRD dalam proses pembentukan peraturan daerah (2) Faktor-faktor yang menghambatproses pembentukan peraturan daerah. Penelitian ini menggunakan analisis data milik John W Cresswell. Hasil penelitian ini menunjukkan bahwa dalam pembentukan Peraturan Daerah antara lain meliputi empat tahapan, terdiri dari ; tahap Pengkajian, tahap perencanaan, tahapan pembahasan, dan tahap Pengesahan. Dari hasil penelitian juga ditemukan bahwa dalam proses fungsi legislasi DPRD selama tahun 2013-2017 mengalami kemunduran dimana DPRD semakin pasif. Hak inisiatifnya menjadi berkurang hingga tidak digunakan sama sekali. Namun proses pelaksanaan fungsi legislasinya telah berjalan sesuai dengan peraturan perundang-undangan yang berlaku. Tetapi masih terdapat kendala-kendala yang mempengaruhi fungsi lengislasi DPRD ini diantaranya adalah SDM yang kurang mumpuni, molornya proses pembentukan Raperda, dan kurang melibatkan masyarakat.
English Abstract
One of the instruments in the implementation of Regional Goverment is Regional House Of Representative, which is the representative institution of the people of the local region. Regional House Of representative has Legislation Function which is conjointly with The Regional Head. The legislative function of Regional House Of Representative is the function of the formation of regional regulations with the regional head that must be guided as regulated in Law Number 12 Year 2011 About Establishment of Legal Services. To perform its functions Regional House Of Representative Members also have certain rights, one of which is the Right of Initiative to initiating draft of local regulation. Local Regulation which is one of the important instruments for Local Government, Regional Law adjust special issues in the local area that not regulated in constitution. Sukoharjo’s Regional House Of Representative is one of the regional whose initiatives right are high in 2013. But in the year 2014-2017 the uses of the right of initiative of Regional House Of representative decreased drastically. The purpose of this research is to know and analyze the role of legislative function of DPRD Sukoharjo Regency. This research uses descriptive research type with qualitative approach. This Research located in the Regional House of Representative of Sukoharjo Regency. In thisresearch limited by two focuses of research those are(1) The role of legislative function of DPRD in forming process (2) Factors that obstructing regional regulation forming proses. This research uses John W Cresswell's analysis data. The results of this research indicate that in the formation of Regional Regulations among others includes four stages, consisting of; Assessment stage, planning stage, stages of discussion, and the stage of Legalization. From the results of the research also found that in the process of legislative function of DPRD during the year 2013-2017 encounter the regression wheren the parliament be more passive. The rights of the initiative are reduced to no used at all. However, the legislative process has been implemented in accordance with the applicable regulations. But there are still obstacles that affect the legislative legislation function there is among the less qualified human resources, the slow process of forming local regulation, and less involving the community
