Abstract
Dalam Studi kasus penetapan hakim Pengadilan Agama adanya pertentangan dengan Kompilasi Hukum Islam dan Undang-Undang Nomor 1 Tahun 1974. Dimana hakim bertentangan aturan yang ada pada Pasal 153 ayat 2 huruf c Kompilasi Hukum Islam terkait masa iddah wanita yang hamil. Dijelaskan bahwa masa iddah wanita hamil adalah sampai melahirkan. Namun disini hakim dalam dasar pertimbangannya hal tersebut dapat bertentangan dengan pasal 53 Kompilasi Hukum Islam terkait Nikah Hamil. Namun bila kita teliti hal tersebut akan bertentangan pula dengan pasal 40 Kompilasi Hukum Islam terkait Larangan Perkawinan. Bila melihat salah satu tujuan hukum adalah keadilan, maka hal tersebut tidak memberikan keadilan pada pihak suami. Sebab telah jelas yang melakukan kesalahan adalah wanita tersebut dengan melakukan hubungan suami istri dengan laki-laki lain hingga dia hamil.
English Abstract
In the case study was the determination of the Religious Court judges contradiction with Compilation of Islamic law and Law Number 1 of 1974. Where the judge contradicts the existing rules on Article 153 paragraph 2 letter c Compilation of Islamic law related to the prescribed period of pregnant women. It was explained that the prescribed period of pregnant’s women is to give birth. But here, the judge in the considerations it can be breached with Article 53 Compilation of Islamic Law Wedding Pregnant related. But if we are careful anyway it may be contrary to Article 40 of the Compilation of Islamic Law Related Marriage Prohibition. When you see one of the aims of the law is justice, it does not give justice on the part of the husband. For it’s sure who making a mistake is the woman with marital relationship with another man until she was pregnant.
