Abstract

Skripsi ini membahas mengenai alasan ketidakpatuhan Australia terhadap perjanjian SPS. Pada tahun 1995, Australia menandatangani sebuah perjanjian dalam bidang pertanian yaitu Agreement on Agriculture (AoA) WTO dimana dalam perjanjian tersebut terdapat perjanjian dalam bidang pertanian yang lebih spesifik yaitu perjanjian Sanitary and Phytosanitary Agreement (SPS). Australia terlibat sengketa dengan Selandia Baru dikarenakan Australia terbukti melanggar beberapa pasal dalam perjanjian SPS dan terbatasnya kemampuan pemerintah Australia betindak sesuai dengan perjanjian SPS dari sisi birokrasi, kajian ilmiah serta keterbatasan dari sisi finansial dalam menerapkan perjanjian SPS. Ketidakpatuhan Australia bermula dari sikap Australia yang mengeluarkan kebijakan pembatasan impor apel khusus apel Selandia Baru pada tahun 2007. Hal ini kemudian memunculkan pertanyaan mengapa Australia tidak patuh terhadap perjanjian SPS. Dalam menganalisis kasus ini, penulis menggunakan teori noncomplying behavior dari Abram Chayes dan Antonia Handler Chayes. Hasil analisis menunjukkan bahwa alasan Australia tidak mematuhi perjanjian SPS adalah karena ketidakjelasan bahasa (ambiguity) dari isi perjanjian sehingga menimbulkan perbedaan interpretasi, adanya keterbatasan kapasitas dalam penerapan kajian ilmiah, birokrasi dan finansial Australia serta adanya perubahan dari sisi ekonomi dan sosial di Australia.

English Abstract

This thesis discusses the reasons for Australia's non-compliance with the SPS agreement. In 1995, Australia signed an agreement in the field of agriculture, namely the WTO Agreement on Agriculture (AoA) wherein there was a more specific agreement in the field of agriculture, namely the Sanitary and Phytosanitary Agreement (SPS). Australia was involved in a dispute with New Zealand because Australia was proven to violate several articles in the SPS agreement and the limited capacity of the Australian government to act in accordance with the SPS agreement in terms of bureaucracy, scientific and financial limitations in implementing the SPS agreement. Australia's disobedience stems from the attitude of Australia which issued a policy of limiting the import of New Zealand apple apples in 2007. This then raises the question why Australia is not compliant with the SPS agreement. In analyzing this case, the authors used the theory of noncomplying behavior from Abram Chayes and Antonia Handler Chayes. The results of the analysis show that the reason Australia does not comply with the SPS agreement is because ambiguity of the contents of the agreement gives rise to different interpretations, limited capacity in the implementation of Australian scientific, bureaucratic and financial studies and changes in economic and social terms in Australia.
