Abstract
Turki merupakan negara transit maupun destinasi yang telah menandatangani Konvensi 1951 yang berkaitan dengan Pengungsi. Namun, Turki mengadopsi pembatasan geografis sehingga pengungsi yang bukan berasal dari negara non-Eropa tidak akan diberi status pengungsi. Turki merupakan negara yang berbatasan langsung dengan Suriah yang dimana telah terjadi konflik di dalam Suriah sejak tahun 2011. Sejak konflik, Turki memberikan Open Door Policy bagi pengungsi Suriah sehingga mereka dapat masuk ke dalam Turki. Namun, karena adanya pembatasan geografis, pengungsi Suriah di Turki hanya dianggap sebagai tamu dan tidak mendapatkan hak-haknya sebagai pengungsi. Seiring berjalannya waktu di tahun 2014, Turki mendeklarasikan Temporary Protection Regulation sebagai respon untuk pengungsi Suriah yang datang. Regulasi ini menjadi acuan Turki untuk memerhatikan hak-hak yang harus didapatkan pengungsi Suriah. Turki sebelumnya tidak pernah sebaik ini dalam merespon kedatangan pengungsi yang bukan berasal dari Eropa. Bahkan Turki kini menjadi negara yang paling banyak dalam menampung pengungsi Suriah daripada negara lainnya. Walaupun, adanya tekanan dari berbagai pihak, Turki tetap menunjukkan komitmennya dalam memberikan respon yang positif. Oleh karena itu, perlu melihat faktor yang mempengaruhi respon positif Turki. Penulis menggunakan model Factors Influencing Refugee Policy Choices milik Karen Jacobsen yang memiliki 4 variabel faktor antara lain keputusan birokratik, hubungan internasional, kapasitas penyerapan melalui masyarakat, dan pertimbangan keamanan nasional.
English Abstract
Turkey is a transit and receiving country who is the signatories of Convention 1951 relating to the Refugee. However, Turkey adopt geographical limitation so refugees who are not from Europe are not getting refugee status. Turkey is a country who is directly bordering with Syria, where there has been a conflict since 2011. Since the conflict, Turkey has provide Syrian refugees with an Open Door Policy so they can enter Turkey. However due to geographical restrictions, Syrian refugees in Turkey are only considered as a guest and they are not get their right as a refugee. As time passes in 2014, Turkey declared Temporary Protection Regulation as a response to the arrival of Syrian refugees. This regulation become Turkey reference to ensure the rights of Syrian refugees. Turkey had never been good country in responding to the arrival of refugees who were not from Europe country. In fact, Turkey is now hosts the largest Syrian refugees than any country. Despite of pressure from various actors, Turkey continued to show her commitment in giving a positive response. Therefore, it is necessary to see factors that influence positive response of Turkey. The author used the model Factors Influencing Refugee Policy Choisces by Karen Jacobsen that contains 4 main variables which are, bureaucratic choices, international relations, local absorption capacity, and national security consideration.
