Abstract
Filipina merupakan negara anggota ASEAN pertama yang meratifikasi Konvensi 1954 tentang status sateless persons ke dalam hukum administratifnya yang dikeluarkan pada 18 Oktober 2012 dalam bentuk Surat Edaran No.058 yang berjudul Prosedur Penetapan Status Pengungsi dan Stateless Person. Setelah meratifikasi Konvensi 1954 dan mengeluarkan Prosedur Penetapan Status, Filipina berhasil memetakan 8.745 orang keturunan Indonesia yang stateless di wilayahnya, dimana 664 orang telah mengakhiri status mereka sebagai stateless persons. Untuk menurunkan ketentuan-ketentuan yang ada dalam Konvensi 1954 ke dalam Prosedur Penetapan Status, Filipina sedikit banyak telah melakukan transfer kebijakan (policy transfer), proses dimana pengetahuan tentang kebijakan, pengaturan administratif, institusi, dan gagasan dalam suatu sistem politik (dulu atau sekarang) digunakan dalam pengembangan dalam sistem politik lainnya. Keberhasilan Filipina dalam memberikan status dan perlindungan kepada stateless person mendasari penelitian ini. Dengan menggunakan konsep policy transfer Dolowitz dan Marsh, peneliti ingin melihat lebih dalam bagaimana proses policy transfer Konvensi 1954 tentang status stateless persons diturunkan dalam prosedur penetapan status pengungsi dan stateless person di Filipina Tahun 2012. Penelitian ini merupakan penelitian deskriptif yang mengumpulkan data dengan studi kepustakaan dan dianalisis dengan menggunakan analisis data kualitatif.
English Abstract
The Philippines is the first ASEAN member country to ratifies the 1954 Convention relating to the Status of Stateless Persons into its administrative law issued on October 18, 2012 in the Department Circular No.058 entitled Establishing The Refugee and Stateless Person Status Determination Procedure. After ratifying the 1954 Convention and issuing the Status Determination Procedure, The Philippines success into mapping 8.745 stateless Indonesian’s descents in its territory, which is 664 people have ended their status as stateless persons. In order to derive the provisions of the 1954 Convention into the Status Determination Procedure, The Philippines have made policy transfer, process by which knowledge about policies, administrative arrangements, institutions and ideas in one political system (past or present) is used in the development in another political system. The success of the Philippines in providing status and protection to stateless persons underpinning this research. By using Dolowitz and Marsh’s policy transfer concept, researcher would like to see more about how the policy transfer process of 1954 Convention on the Status of Stateless Persons derived to the procedure for determining Refugee status and Stateless Person in the Philippines in 2012. This is a descriptive research in which the data collected by literature research process and analyzed using qualitative data analysis method.
