Abstract

Penelitian ini bertujuan untuk memahami faktor pengunduran diri Burundi dari International Criminal Court pada tahun 2016. International Criminal Court menjadi lembaga pengadilan internasional yang mengadili segala tindak kejahatan kemanusiaan, genosida, agresi, dan tindak kejahatan perang. Burundi termasuk sebagai negara anggota ICC yang telah berkomitmen untuk memberikan yuridiksi kepada ICC sejak tahun 2004. Burundi dianggap sebagai negara yang kooperatif ikatannya dengan ICC. Namun, kondisi tersebut berubah ketika ICC menyerukan kegiatan investigasi yang ingin dilakukan oleh ICC di Burundi, yang menyebabkan Burundi pada akhirnya memutuskan untuk mengundurkan diri dari International Criminal Court pada 27 Oktober 2016. Dalam menganalisa penelitian ini, penulis menggunakan konsep determinant factors on foreign policy yang dicetuskan oleh William D. Coplin. Dan hasil dari penelitian menemukan bahwa keputusan Burundi mengundurkan diri dari ICC pada tahun 2016 dilatar belakangi oleh tiga faktor yakni Domestic politics, international circumtances, dan decision making behavior.

English Abstract

The purpose of this research is to find out the factors behind the decision of Burundi related to its withdrawal from The International Criminal Court in 2016. The International Criminal Court is an international tribunal to prosecute individuals for the international crimes of crimes against humanity, genocide, aggression, and war crimes. Burundi is one of The International Criminal Court member states since Burundi has given the jurisdiction to The ICC in 2004. Burundi is considered as a cooperative country due to its relations with The ICC. But this condition changed, when the ICC announced an investigation that will be held in Burundi in 2015, that eventually made Burundi decided to withdrawal from The International Criminal Court on 27th of October 2016. The concept that used in this research is a concept by William D. Coplin called Determinant Factors on Foreign Policy. And the result of this research prove that the decision of Burundi’s withdrawal from The International Criminal Court (ICC) in 2016 is caused by 3 significant factors, that is domestic politics, international circumtances, and decision making behavior of the leader.
