Abstract

Penelitan ini merupakan studi tentangmengamati dinamika konflik serta penyebab timbulnya konflik yang terjadi antara pengusaha hotel Srabah Semesta Resort di Kabupaten tulungagung dengan Pemerintah Daerah Kabupaten Tulungagung terkait dengan Peraturan Daerah Nomor 17 Tahun 2010 tentang penyelenggaraan Izin Mendirkan Bangunan. Tujuan penelitian ini adalah untuk mengetahui bagaimana dinamika konflik yang terjadi antara pengusaha hotel dan pemerintah kabupaten Tulungagung.Penelitian ini menggunakan metode kualitatif dengan menggunakan teori konflik Johan Galtung.Hasil penelitian ini adalah akar penyebab konflik yaitu minimnya pemahaman tentang regulasi khususnya menjelaskan tentang permohonan pengajuan izin mendirikan bangunan baru terhadap perenovasian sebuah bangunan yang diharuskan memiliki IMB baru sesuai dengan regulasi yang ada. Tetapi pihak hotel Srabah Semesta Resort melakukan perenovasian bangunan tanpa memiliki surat Izin Mendirikan Bangunan Baru. Sebelumnya pihak hotel srabah sudah pernah melakukan pengajuan permohonan IMB, tetapi persyaratan tersebut masih kurang lengkap.Maka pihak DPMPTSP melakukan kontak secara lisan tetapi kontak tersebut tidak dapat dihubungi. Maka dari itu Pemerintah menerbitkan surat himbauan pertama sampai dengan ketiga, tetapi tidak adanya respon dari pihak hotel Srabah. Hal tersebut menjadikan pihak pemerintah semakin geram terhadap pihak hotel dan menjadikan konflik ini mencapai puncaknya pada penyegelan bangunan hotel.Konflik ini dalam perspektif johan galtung yaitu adanya ketidakcocokan tujuan antara pengusaha hotel dengan pemerintah kabupaten tulungagung yaitu pengusaha hotel dalam kepentingan ekonomi sedangkan pemerintah kabupaten Tulungagung adalah bentuk penegasan mentaati hukum yang berlaku.

English Abstract

This research is a study about observing conflict dynamics and the causes of conflict that occurred between businessman is Srabah Semesta Resort Tulungagung District with Local Government of Tulungagung Regency related with Local Regulation Number 17 Year 2010 about the implementation of Building Permit. The purpose of this study is to find out how the dynamics of conflict that occurred between the hotel businessmen and the district government Tulungagung. This research uses qualitative method by using theory ofconflict Johan Galtung. The result of this research is the root cause of the conflict that is the miss understanding about the regulation especially explaining about the application for permission to build new building on the renovation of a building which is required to have new building permit in accordance with the existing regulation. But the hotel Srabah Semesta Resort do the building renovation without having the License to Establish New Building. Previously the srabah have never made a request building permit, but the requirements are still not complete. So the DPMPTSP contacts verbally but the contact can not be contacted. Therefore the Government issued the first letter of appeal up to the third, but no response from the Srabah hotel . This makes the government increasingly angry at the hotel and make this conflict to culminate in the sealing of hotel buildings. This conflict in perspective johan galtung that is the mismatch between destination hotel entrepreneurs with tulungagung district government that is hotel entrepreneurs in economic interests while the district government Tulungagung is a form of affirmation in accordance with applicable law.
