Abstract
Pada skripsi ini, penulis mengangkat permasalahan IMPLEMENTASI PASAL 54 UNDANG-UNDANG NOMOR 35 TAHUN 2009 TENTANG NARKOTIKA TERKAIT REHABILITASI ANAK SEBAGAI PECANDU NARKOTIKA DI KABUPATEN SAMPANG. Pilihan tema tersebut dilatar belakangi karena Kabupaten Sampang yang mempunyai tingkat penyalahgunaan narkotika yang melibatkan anak dibawah umur sangat tinggi. Dalam hasil pra-survei dari penulis, Badan Narkotika Nasional (BNN) Kabupaten Sampang tidak jarang mengklasifikasikan permasalahan tersebut tidak membedakan pelaku dewasa maupun pelaku anak dibawah umur dengan berbagai alasan tertentu.. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah : (1) Bagaimana Implementasi Pasal 54 Undang-undang Nomor 35 Tahun 2009 Tentang Narkotika Terkait Rehabilitasi Anak Sebagai Pecandu Narkotika di Kabupaten Sampang? (2) Apa hambatan dan upaya dari Badan Narkotika Nasional Kabupaten Sampang dalam mengimplementasikan pasal 54 Undang-undang Nomor 35 Tahun 2009 Tentang Narkotika Terkait Rehabilitasi Anak Sebagai Pecandu Narkotika di Kabupaten Sampang? Kemudian penulisan karya tulis ini menggunakan metode yuridis empiris dengan metode pendekatan yuridis sosiologis. Lokasi penelitian dilakukan di Badan Narkotika Nasional Kabupaten Sampang. Data primer berupa wawancara, sekunder, dan tersier yang diperoleh penulis akan dianalisis dengan menggunakan teknik analisis data deskriptif kualitatif. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa problematika mengenai Implementasi Pasal 54 Undang-undang Nomor 35 Tahun 2009 Tentang Narkotika Terkait Rehabilitasi Anak Sebagai Pecandu Narkotika di Kabupaten Sampang. Ditemukan fakta hukum bahwa Implementasi Pasal 54 Undang-undang Nomor 35 Tahun 2009 Tentang Narkotika Terkait Rehabilitasi Anak Sebagai Pecandu Narkotika di Kabupaten Sampang belum tersedia lokasi/tempat/panti rehabilitasi bagi pecandu narkotika khususnya untuk anak. Hal ini dirasa sangat kurang efektif mengingat semakin meningkatnya para penyalahguna narktika anak di Kabupaten Sampang. Dalam struktur organisasi Badan Narkotika Nasional Kabupaten Sampang terdapat sub bidang rehabilitasi dan terapinya, meskipun belum ada tempat rehabilitasi tersebut. Kendala yang dihadapi oleh Badan Natkotika Nasional Kabupaten Sampang adalah Tidak tersedianya tempat rehabilitasi bagi penyalahguna narkotika anak di Kabupaten Sampang, Jumlah aparat kurang memadai dibandingkan dengan jumlah rakyat dan luas wilayah, Fasilitas/peralatan yang masih kurang, Tingkat pengetahuan masyarakat tentang bahaya narkoba masih sangat kurang.
English Abstract
In this skripsi ,writer raised problems Implementation of Article 54 of Act Number 35 of 2009 concerning Narcotics related with Rehabilitation for Children addicted to Narcotics in the Regency of Sampang. The choice of the theme because in the Regency of Sampang have the level of drugs abuse involving children under the age of very high .In the result pre survey of the writer, the national narcotics agency in the Regency of Sampang not infrequently classifying that problems is not differentiate between adult and children with various some reason . Based on it above, this paper talk about : (1) How Implementation of Article 54 of Act Number 35 of 2009 concerning Narcotics related with Rehabilitation for Children addicted to Narcotics in the Regency of Sampang? (2) What obstacles and the efforts of the National Narcotic Agency Regency of Sampang In Implementation of Article 54 of Act Number 35 of 2009 concerning Narcotics related with Rehabilitation for Children addicted to Narcotics in the Regency of Sampang? Then the writing of a piece of this paper provided by a method of juridical empirical with the methods of an approach to a juridical sociological.The location of the research in the National Narcotic Agency Regency of Sampang. The primary data was in the form of the objective of the interview , secondary , and tertiary offered for its shares will be analyzed writer with uses the technique of the descriptive of qualitative . From the research with the methods above, writer get the answer of the problems about Implementation of Article 54 of Act Number 35 of 2009 concerning Narcotics related with Rehabilitation for Children addicted to Narcotics in the Regency of Sampang. A fact found that of the law that The implementation of Article 54 of Act Number 35 of 2009 concerning Narcotics related with Rehabilitation of Children addicted to Narcotics in the Regency of Sampang is hindered by the unavailability of location for rehabilitation for people addicted to narcotic, especially for children. This is regarded ineffective recalling that the number of addicted individuals is rising in the Regency of Sampang. In the organisational structure of National Narcotic Agency in the Regency, sub-field of the rehabilitation and therapy is provided despite the absence of the place to cope with the rehabilitation. Obstacles faced by the National Narcotic Agency Regency of Sampang is The lack of rehabilitation facility of Children addicted to Narcotics in the Regency of Sampang, among other issues such as larger number of the people and area, lack of facilities, human resources, and knowledge about the danger caused by the drug.
